CFA Chairman John Motta Leads Charge to Lift IRS on Tax Credits


The Employee Retention Tax Credit (ERTC) passed under the CARES Act to encourage businesses to keep employees on their payrolls. The refundable tax credit was up 50% of up to $10,000 in wages paid by an eligible employer during COVID-19 and expired on Sept. 30, 2021, three months earlier than expected, to offset some costs of the infrastructure bill.


While the ERTC was a helpful tool to keep franchisees’ employees on payroll, many business owners still have not received the tax credit. Come filing time, however, Internal Revenue Service (IRS) still taxed the credit as income.


Enter CFA Chairman John Motta. A New Hampshire and Virginia-based Dunkin’ franchisee, John asked Sen. Maggie Hassan (D-NH) to address the issue with the IRS; she immediately asked the IRS to correct the problem, citing John as an example.


On April 18, the IRS issued a news release clarifying that employers need not pay the penalty arising from additional taxes owed if they have not yet received their ERTC.

The NLRB's Aggressive Stance on Unions

Over the past several months, the National Labor Relations Board (NLRB) has taken a strong stance in supporting the union agenda. In April alone, NLRB General Counsel Jennifer Abruzzo asked the board to reconsider cases that limit an employer's ability to (1) discuss the issue of unionization with employees and (2) question whether a majority of employees actually supported unionization.

Starbucks Faces Sanctions for Firing Union Organizers

A federal regulator has sided with Starbucks employees in their claim the coffee giant fired seven baristas in Tennessee as retaliation for their pro-union stance, a violation of the regulations governing the organizing process. An official of the National Labor Relations Board (NLRB) has tentatively ruled that Starbucks must “make whole” the seven former workers.

The Essential Workers for Economic Advancement Act (EWEA) creates a three-year H-2C visa program for nonimmigrant service workers. The program would fill nonagricultural jobs that have lower educational thresholds and is intended for small businesses in industries with comparatively low sales per employee.
