Notice of Hearing re: Trust of Faerie L. Angle

Notice is hereby given that a hearing is scheduled for 9:00 a.m. on Wednesday, April 3, 2019 in the assigned Courtroom of the Franklin County Courthouse, Chambersburg, Pennsylvania.
 
At the hearing, the Orphans' Court will consider a request of the petitioner, Manufacturers and Traders Trust Company, to terminate the trust of Faerie L. Angle, late, of Waynesboro, Pennsylvania, and to distribute the assets to the Foundation for Enhancing Communities, 200 N. 3rd St., Eighth Floor, Harrisburg, PA 17101, to be administered as a fund for the purposes provided in this notice. Under the current terms of the trust the trust income is to be used to provide scholarships for young persons from Franklin County, Pennsylvania, studying to be lawyers, one half of the money given to be a gift, and the other one half of the money given to be a loan at current fixed rates of interest, to be repaid to the trust, for trust purposes, within 10 years from receipt of the money by the recipient.
 
The current Trustee, Manufacturers and Traders Trust Company desires to end its fiduciary responsibilities and asserts that certain terms and conditions of the trust should be removed including the loan provision of the trust. In addition, the trustee proposes that the Foundation for Enhancing Communities should be directed to provide scholarships to law students from Franklin County, Pennsylvania, and in the event that there are no applicants for a period of three years, that distribution of the income may be made to students attending law schools from adjoining counties, based upon objective and non-discriminatory criteria.
 
Pursuant to the Pennsylvania Uniform Trust Act 20 Pa. C.S. § 7740.3(a) & (e), the court shall apply cy pres and receive evidence to determine whether or not the proposed termination, and/or modification of the trust, will fulfill, as nearly as possible, the settlor's charitable intention, whether it be general or specific, and determine whether or not such termination of trust should be granted based upon an assertion that the current activities and restrictions placed upon the trust result in it being impractical or wasteful. 
 
If you desire to receive any additional information regarding the current trust, the proposed termination and distribution of the trust to the Foundation for Enhancing Communities, and the Foundation's distribution of income going forward, you may contact Counsel for the Petitioner, Jay R. Donations of used and new books on all subjects, including paperbacks, are needed. We also welcome artwork, CDs, DVDs, sheet music, audio books (on CD), puzzles, and board games.
 
Encyclopedias, textbooks, cassettes, and VHS tapes (except Disney) are not accepted. A special silent auction section will be reserved for artwork and

In 2018 our website's Find A Lawyer directory was used by more than 1,800 people. Our office receives calls for attorneys every day and provides the same information from the website's directory.
 
We've made it easier and faster to apply for the Find A Lawyer program. You do not need to send a copy of your malpractice insurance to us. You may choose to pay for the additional listings (areas of practice) using a credit card on our website or I will send you an invoice if you select more than 1 area of practice.

Naturalization Ceremony
June 14, 2019


The Court is going to hold a naturalization ceremony on June 14, 2019.  Assisting with this will be the Franklin County Chapter of the Daughters of the American Revolution.  The Bar and Franklin County Legal Services are invited to participate and to let individuals who may be eligible for naturalization that this is happening.  The ceremony will be held at 2 p.m. The Franklin County Chapter of the Daughters of the American Revolution will host a small reception.

Introduction to Family Immigration: My family member is a U.S. citizen, what do I do?
Session 2 will focus on family-based immigration. The session will cover who can petition for their family members as well as providing an overview of the family-based immigration process including adjustment of status and consular processing. Practitioners will receive nuts and bolts tips on preparing and submitting applications as well as information on developing issues in the field of family immigration. 


Introduction to Immigration Continuing Legal Education Series   
Have you considered adding immigration law to your practice or simply interested in learning more about this hot topic?  The Introduction to Immigration CLE Series will provide you with a basic understanding of immigration law and is intended for practitioners who have no or very little immigration law experience.  Immigration law is a complex topic.  This CLE series will provide the basic groundwork to assist someone in starting to learn the various components of the system.  The following are a list of sessions with brief descriptions:
  1. Introduction to Immigration: What do all these acronyms mean?
    • Session 1 will focus on laying the groundwork necessary to understand the various aspects of immigration with a specific focus on providing background on all of the terms and acronyms used within immigration.

  2. Introduction to Family Immigration: My family member is a U.S. citizen, what do I do?
    • Session 2 will look at basic family immigration cases including the petition process and adjustment of status versus consular processing.
  3. Introduction to Naturalization: Basics of Applying for Citizenship
    • Session 3 will introduce you to the naturalization process.  It will help you to identify issues that may cause problems for someone in their naturalization process.
  4. Introduction to Employment Immigration I: Nonimmigrant Visas
    • Session 4 will look at temporary visas like student visas where the person is coming for a specific purpose with plans to return to their home country.
  5. Introduction to Employment Immigration II: Immigrant Visas
    • Session 5 will discuss the process an employer must do in order to petition for a green card for an employee.
  6. Introduction to Special Immigrant Juvenile Status: Custody and Unaccompanied Minors
    • Session 6 will provide information for situations when custody and immigration meet for children who entered or attempted to enter the U.S. without a parent or guardian.
  7. Introduction to Crimmigration: Will that criminal conviction make my client removable?
    • Session 7 will focus on the cross section between criminal law and immigration and with a specific focus on evaluating the immigration impact of a criminal conviction.
  8. Introduction to Humanitarian Immigration: Asylum, VAWA, and Visas for Victims of Crimes
    • Session 8 will discuss the various types of visas and immigration process for those seeking protection whether that protection be from persecution, domestic violence, or because the person was a victim of a crime. 
Our facilitator: Brittany Henderson is an Attorney with Franklin County Legal Services.  Prior to joining Franklin County Legal Services, Ms. Henderson worked for a nonprofit organization in West Virginia providing immigration legal services to low-income immigrants and their families.  She also worked with refugees resettling in the state.  She previously worked for the American Immigration Lawyers Association (AILA) and for Congressman Luis V. Gutierrez as an immigration fellow.  Ms. Henderson graduated from the University of Miami School of Law in 2012 with her law degree and a Masters of Law in international law.  In law school, she participated in the Immigration Clinic where she argued in front of the Eleventh Circuit Court of Appeals, interned with the Miami Immigration Court, and interned with an immigration legal services nonprofit that serves unaccompanied immigrant minors.  Prior to law school, Ms. Henderson attended Shepherd University where she majored in Political Science and Spanish.  Ms. Henderson is a member of AILA and is fluent in Spanish.  She is admitted to practice in Pennsylvania, West Virginia, and New York.

Guardianship Tracking System Workshops
The Administrative Office of the Pennsylvania Courts (AOPC) is offering a series of workshops that show court-appointed guardians how to use the new Guardianship Tracking System (GTS). The GTS makes it possible for guardians of adult incapacitated persons to file inventory and annual reports online from any internet-accessible computer.
We are pleased to offer these workshops in both an online and in-person format.
 
Each workshop covers the same information so feel free to attend any session that fits your schedule. Registration is required for all workshops through WebEx.

The Franklin County Bar Association is pleased to announce that we have partnered with Axom Education to offer online courses for PA CLE!  

Our first online course, which we hope to expand to a series, is Spanish for Lawyers: An Intro to Basic Legal Terminology in Law Offices and Courts, presented by Renu Urvashi Sagreiya, Esq. It's available now for $10 for 1 PA substantive credit or free for noncredit at:



This course is being offered at a discount rate as part of an effort to expand access to legal services for Spanish speaking clients.  The course is taught in Spanish and designed for attorneys with basic Spanish skills to improve their knowledge of legal terminology and concepts.

Member News

 

In mid-January, Lauren E. Sulcove became an Associate at B & D Law Group (formerly Black and Davison), as well as Family First Estate Services, a full-service firm specializing in wills and estate administration.  She is a 2004 graduate of Temple University James E. Beasley School of Law and a 1990 summa cum laude graduate of the University of Denver.  Prior to joining B & D Law Group, Mrs. Sulcove spent thirteen years prosecuting homicide, child abuse, and sexual assault cases.  Eventually, she was appointed First Assistant District Attorney of Franklin County, a title she proudly held from 2014 through 2017.  Most recently, she served as a Deputy Attorney General of Pennsylvania, defending Pennsylvania State Police troopers, corrections officers, and other state agents in civil rights actions.  Her work as a Deputy Attorney General also allowed her to represent Pennsylvania state universities in employment discrimination suits.  Mrs. Sulcove is licensed to practice in the United States Court of Appeals for the Third Circuit, the United States District Courts for the Eastern and Middle Districts of Pennsylvania, and all of the state courts.  She recently became a board member of the Franklin County Library System, and she is a long-term member of the Pennsylvania and Franklin County Bar Associations.  In law school, where she met her husband (Jerrold), Mrs. Sulcove was an editor of the Temple Political & Civil Rights Law Review and a member of the Moot Court Honor Society.  At B & D Law Group, Mrs. Sulcove focuses her practice in the areas of family law, wills and estates, and elder law.

The YLD will be hosting another Wills for Heroes event in the near future for our Franklin County Sheriff's Department. The event will be held at the Franklin County Bar Association office. Maybe you have helped with these events in the past or maybe you don't really know what the program does! Either way I'd like to share a bit of information about the program and encourage you to become involved or, if you have already involved, help you realize the importance of the volunteer work you are doing!
 
I personally feel that Wills for Heroes is a very worthwhile and important program because it gives back to the community and protects those who protect us. The Franklin County YLD has participated in this program for many years, although we did have a gap in events a few years ago due to a turn-over in coordinators which took some time due to mandatory training through the PBA.

So what is Wills for Heroes? 
WFH began as a program to provide essential legal documents free of charge to our nation's first responders. The fundamental purpose of the program is to provide those on the frontlines for our personal safety with the tools they need to prepare adequately for the future. By helping first responders plan now, they ensure their family's legal affairs are in order before a tragedy hits. To accomplish this goal, volunteer attorneys prepare wills, living wills, and powers of attorney for these first responders. According to the Wills for Heroes Foundation, eligible first responders include firefighters, law enforcement officers, emergency medical responders, and corrections and probation officers from federal, state, county, city and town departments and agencies, including retired and volunteer first responders. In 2017, the Pennsylvania Bar Association announced that the WFH program would begin to include veterans.

Why did this program come to be? 
WFH was started by Anthony Hayes, a partner at Nelson Mullins Riley and Scarborough, LLP, in Columbia, South Carolina, shortly after the September 11, 2001, terrorist attacks. Anthony asked the Columbia Fire Department what lawyers could do to help that department and it was quite clear that there was a need for estate planning services. According to a November 12, 2007, Forbes magazine article, a PNC Wealth Management survey found 30% of adults with investable assets of $500,000 did not have a will; the same article references a Harris Interactive survey done for lawyers.com that found that 55% of the general population had no will. According to the Wills for Heroes Foundation, those numbers are even lower for the first responder community; despite the inherently dangerous nature of their jobs, an overwhelmingly large number of first responders - approximately 80-90% do not have even simple wills according to experiential data and feedback from first responder organizations.

Well, who is in charge of our WFH program?
In 2016, Alexandra "Alex" Sipe took over for Kevin Taccino as our Wills for Heroes Coordinator for the YLD. Alex Sipe began working with Tucker Maxwell as a Law Clerk in 2012 and became a Partner at Maxwell Sipe Law Offices in 2014. Alex handles estate planning, estate administration, small business planning, and elder law. She is a 2013 graduate of The Dickinson School of Law and a 2010 graduate of Dickinson College. Alex, her husband, and their two children (Max is five years old and Hank is three years old) live in Carlisle. Alex is heavily involved in our community, including the Rotary Club of Waynesboro, Mainstreet Waynesboro, and Waynesboro Day Care. (Oh, and to answer everyone's favorite question - yes, Alex and I think that her husband and I are distantly related, though that's a story for another day!)

Where have the events been recently? 
Since Alex took over, we have hosted three Wills for Heroes events and, besides the upcoming March event, we have plans to host another Wills for Heroes event at the Franklin Fire Company in September. The most recent event was held on November 16, 2018 at the Franklin County Bar Association office where we provided legal documents to members of our very own Sheriff's Office. Approximately ten people were provided with services. In March of 2018, the YLD hosted an event at Franklin Fire Company which is a 100% volunteer fire fighter company that responds to hundreds of calls each year. We were able to serve approximately sixteen people on that day. Alex's inaugural event was held in October of 2017 at Orrstown Church for the veterans at Letterkenny. We were able to assist twelve people in obtaining prepared documents.

When and how do I get involved? 
(Great question, by the way!) As I mentioned, our next event will be held soon (likely by the end of April) and we are always looking for volunteers! Watch the Causeway and your emails for opportunities to volunteer at these events. Alex has been working hard to ensure that we have an event every six months, and for good reason! We rely on preparer volunteers to operate the HotDocs program which churns out the prepared documents. All volunteers need to complete a two-hour training (which does count for free CLE credits) in order to prepare the documents; however, if you have had the training within the last six months or assisted at an event within the last six months, you can forgo the training. In other words, if you participate in training once and continue to volunteer regularly, you come to the events a little later and avoid the training!
