  • SEC Clarifies the Application of Federal Securities Laws to Crypto Assets On March 17, the SEC and the Commodity Futures Trading Commission (CTFC) issued an interpretation clarifying how the federal securities laws apply to certain crypto assets and transactions involving crypto assets. SEC Press Release, CTFC Press Release, Federal Register
  • SEC Proposes Amendments to Exchange Act Rule 15c2-11 which sets out certain information gathering and review requirements for broker-dealers that publish quotations for, or maintain a continuous quoted market in, securities in the over-the-counter (OTC) market. DEPARTMENT OF LABOR (DOL):

  • DOL Proposes Rule for ALTs in 401(k)s The DOL has issued a proposed rule outlining how ERISA fiduciaries can prudently evaluate alternative investments in DC plans, backed by a new six‑factor safe harbor. The proposal aims to reduce litigation risk and place traditional and alternative assets on equal footing.   • Order and Final Judgement Vacating DOL 2024 Fiduciary Rule in March officially removing the regulation from the Code of Federal Regulations. DOL, SIFMA & FSI statement, National Law Review

FINANCIAL INDUSTRY REGULATORY AUTHORITY (FINRA):

  • FINRA Member Firm Fee Rebate In response to receiving higher than anticipated fees in 2025, FINRA’s Board of Governors approved a rebate of 2025 regulatory fees that were distributed at the end of March. FINRA News Blog, PIABA response
  • FINRA Requests Comment on Modernizing FINRA Arbitration Rules, Guidance and Processes Regulatory Notice 26-06 was announced March 2nd with a Comment Period ending Mary 1st. FINRA Notices
  • "The Neutral Corner" (Vol 1, 2026) Visit FINRA's website to access the latest issue with stats on Case Filings and Trends, Rule Approvals, Mediation stats, and other news including an article on new FINRA Rules 12808 and 13808 that accelerate case processing for qualifying parties.
