In June, the U.S. Supreme Court issued a decision in West Virginia v. EPA. that will make it easier for businesses to challenge certain federal regulations in court. The issue at hand? Whether Congress delegated the Environmental Protection Agency (EPA) broad authority to require power plants to change the type of energy they produce. The court found it did not. But the ruling goes beyond just the energy industry and reigns in administrative authority broadly under the major questions doctrine. This means if an agency wants to assert authority, Congress must have clearly delegated these “decisions of vast economic and political significance” to the agency.
