"Future Of Community Associations"

As communities and populations age and expand in Florida, developers and associations both face new challenges that are vastly different from the ones overcome since the turn of the century.  The advent of this century brought such issues as insurance and repair of hurricane damage, Marketable Record Title Act and foreclosures to the forefront.  Community Association laws and practices changed to incorporate the new realities. 

The changing culture, demographics and technology herald new trends.  What's next for community associations?

Collection Of Rents And Evictions

Both the Condominium Act and the Homeowners Association Act provide that an Association may demand payment of rents by the tenant of a property if the owner of that property is delinquent in the payment of assessments to the Association.  This "interception of rents" can allow the Association to avoid the time and expense of more involved Collection efforts. We will assist the Association in receiving rents directly from the tenant and applying those rents to the owner's delinquency.  Once the delinquency is paid off, the flow of rents returns to the owner. If the tenant refuses to pay the rents to the Association, then Clayton & McCulloh, can pursue legal proceedings to evict the tenant. These collection of rents and tenant eviction services are charged as a fixed rate service, however, if the owner contests the tenant eviction lawsuit, then the fees will thereafter be charged at an hourly rate.

Presenting The 1 st Quarter 2017 Most Awesome Board Member:
Tom Fortin of Rose Hill HOA 

John Clark of Rose Hill HOA nominated their treasurer saying "Tom Fortin has been a homeowner for at least 30 years in Rose Hill Phase I in Orange County. He has served in various capacities with the HOA during those years. During the past five years, he has served as HOA board member and Treasurer. He has diligently worked to bring down the chronic late and overdue HOA dues from homeowners. He has also worked to ensure all funds due to the Association from the sale of homes in the neighborhood were received. As Treasurer, he has managed to increase the funds in the HOA account in order to enable the HOA to seriously consider installing a camera at the entrance to Rose Hill. More recently, over a two to three-year period, he worked with our attorneys to fight a suit by a then current and now former homeowner. He stayed very close to the case and tenaciously oversaw the progress of the suit with our attorneys which resulted in winning the suit. Mr. Fortin also works quietly in the background to bring new homeowners into the HOA as members of the various committees maintained by the HOA. His drive and desire for a well-maintained neighborhood has been evident in his support of the HOA's Architectural Review Board efforts to maintain and enforce the Planning Criteria for our HOA. Tom is an accessible and friendly individual who listens and then takes decisive action when necessary. We are most fortunate to have such a capable and caring person serving on our HOA Board of Directors."

Mosquito Control Fundamentals

Mosquitoes have been a part of our ecosystem since the beginning of time. As a matter of fact, prior to OrangeCounty existing as we know it today, it was originally known as Mosquito County. Yes, mosquitoes can cause havoc for all of us during an outdoor party, a reception or simply just enjoying the evening in your backyard. If it wasn't for the dedicated individuals that work to fight the bite, our quality of living would not be what it is today. Even though we have very good control/mitigation measures, mosquitoes are a constant battle, but if we stopped the control efforts just imagine how unbearable it would be.

Given the many diseases that mosquitoes carry and now the newest one on the radar, Zika, the war on this pest is not getting any easier. Although there are many ways to protect yourself, such as repellents, netting, long sleeves and pants, the constant vigil of the mosquito control professional is our greatest asset. The professional Mosquito Control expert will work to target the mosquito while limiting the impact on beneficial insects such as Honey bees, Lady Bugs, Butterflies and Dragonflies. Since some of the beneficial insects help to pollinate our fruits, flowers and vegetables, it is of utmost importance that we conduct our business wisely to minimize the impact on non-target insects.

As many of us are accustomed to either seeing or hearing the mosquito control truck coming through the neighborhood in the evening or early morning hours to help manage the pests, keep in mind that they are doing this for maximum mosquito knockdown; furthermore they are maximizing the beneficial impact. As a consumer be very careful when applying a Barrier treatment or spraying your trees, hedges or lawns especially on flowering plants with a pesticide that has a residual; this is where the greatest consequence occurs. Those pesticides are present when the pollinating insects come out, and they are now decimated. In the past, the professional mosquito control technician only used barrier treatments when absolutely necessary and the impact was simply a casualty of the war, so choose your mosquito control efforts wisely.

As a homeowner, some of the best ways to mitigate mosquito larva are to simply keep any water retaining items empty and stored out of the weather. If you have plants that retain water, such as bromeliads, keep those flushed out with a water hose every few days. If you have issues with mosquitoes, notify your City or County mosquito control department, or call a responsible professional mosquito control company so a technician can respond to conduct an inspection as to the source of the pest as well as the best means to mitigate the problem. Generally, a Larvicide product in waterways or water-holding objects, hand or truck Adulticiding (fogging) in the evening or early morning hours will quickly manage your problems. By doing these few things we can all live a healthier, more enjoyable lifestyle as we Floridians enjoy the inviting and entertaining evenings we have come to enjoy.
