Spring Greetings! I’d like to update you on the Maryland Pesticide Education Network’s (MPEN) efforts to phase out PFAS-pesticides in the 2025 Maryland General Assembly session (Jan-Apr 2025). Although the bill did not pass, we achieved a crucial PFAS victory. And it has implications to the health care field. 


This is a David vs. Goliath story.


Unexpectedly, Maryland became the target of a pesticide industry attack on the scientific definition of PFAS, known as ‘forever chemicals.’ PFAS are highly persistent and cumulative, causing certain cancers and linked to various health issues like cardiovascular disease, birth defects, and immune suppression. In fact, PFAS contamination has now been recognized as a national crisis.


We worked with key legislators on drafting a Maryland bill they sponsored, phasing out PFAS-pesticides, supported by a coalition of public health and environmental organizations and globally renowned PFAS scientists.


Unfortunately, well-resourced chemical industry lobbyists successfully pushed for amendments that significantly altered the scientifically accepted PFAS definition. Established by the global Organization for Economic Cooperation and Development (OECD), this definition, co-authored by the U.S. EPA and 36 other nations, is used by multiple government agencies and is already codified in Maryland law and 23 other states. The amended bill proposed a narrower, industry-favored interpretation that excludes many PFAS-containing substances, including pesticides, from regulatory oversight, without scientific basis.


Despite evidence countering industry false narratives and MPEN’s offering concessions, the Maryland House passed the revised bill, driven by legislators’ well-intentioned desire to address PFAS this year.


This matters: The amended PFAS definition exempted half of the 15,000 PFAS chemicals and 90% of PFAS-pesticides from regulation, yet they remain hazardous. This change would have protected the chemical industry, not people or the environment, by shielding products, profits, and liability.


Worse, the bill codified the weakened definition into MD law, indemnifying PFAS-pesticides and the industry from future protections. It would have threatened Maryland’s existing PFAS protection laws and affect future protections on all PFAS products. This industry change was meant to justify similar changes in other states and nationally, as part of the chemical industry’s strategy to weaken PFAS protection laws nationwide.


Important to healthcare facilities: PFAS-pesticides, though less than 8% of registered pesticides in Maryland, are widely used in healthcare settings, schools, homes, and agriculture. Only Maine and Minnesota have passed laws phasing them out, which are now being challenged by the global pesticide industry. MPEN and the MD public health and environmental advocacy community fought to kill their own bill, preventing it from becoming a gift to the chemical industry and a disaster for Marylanders and the nation.


A victory: We stopped the industry-amended Maryland bill from becoming law! We prevented a destructive pesticide industry win from setting a national precedent.  


Hospitals and healthcare facilities should be aware of this situation. See posting below regarding a first-in-the-state study on PFAS in Marylanders’ blood. Imagine facility areas where patients cannot be removed prior to a pesticide application (e.g. NICUs, ICUs, ERs) and thereby potentially exposing them to a PFAS-pesticide. Even just one exposure can impact them for years. It has now become even more important to know what your pest control vendor is using at your facility. Are PFAS Pesticides Hiding in Your Facility?

Many healthcare facilities trust that the products used to manage pests are safe for patients, staff, and visitors. Unfortunately, the pesticide manufacturing industry has a long history of utilizing products that may contain PFAS, harmful “forever chemicals” linked to serious health issues, but often marketed as "low-risk" products. Even if you and your vendor believe that your facility is using the safest options, common pest control products in hospitals and long-term care settings can contain PFAS as an active ingredient.


Recent reports have exposed how industry lobbying has attempted to weaken legislation designed to phase out PFAS pesticides, prioritizing profits over public health. The reality is that without stronger oversight and informed decision-making, healthcare facilities may unknowingly contribute to PFAS exposure, increasing long-term health risks and environmental contamination. Now is the time to take control. By prioritizing Integrated Pest Management healthcare leaders can ensure their pest control choices align with their mission to protect health.

To protect your facility, reference the list of commonly used PFAS active ingredients in the graphic below. Share this list with your pest control vendor and request that they do not use these products in your facility. Taking this step helps reduce toxic exposures and ensures that pest management practices support, rather than compromise, patient and worker health.

Check your disinfectants for risk level


Some regularly used disinfectants in facilities are actually registered pesticides that can deplete a patient’s immune system and harm respiratory function. Use the SaferDisinfectants.org website to see if what your facility uses is an “increased risk” or “safer” product.


Go to the SaferDisinfectants.org website's The List page and search your products by name, using your browser search keys, "Command + F" on Macs and "Control + F" on PCs. Type in the name to see if it has an increased risk or is a safer choice. View the Safer Choice list and sort by use site and need for better product choices.

PFAS in Maryland: Evidence from a Pilot Study and Expert Testimony

A groundbreaking pilot study conducted in Maryland revealed elevated levels of PFAS in the blood of an alarming number of participants across the state. Blood samples from 41 residents showed that 100% of participants had detectable PFAS levels, with 95% of individuals reaching thresholds that warrant increased monitoring for PFAS-related health impacts. Even more concerning, 10% of participants had PFAS levels so elevated that additional testing during routine medical visits is recommended according to the National Academy of Sciences, Engineering, and Medicine (NASEM). These findings highlight the widespread and pervasive nature of PFAS exposure, with significant implications for public health in Maryland.


Dr. Ana Rule, Assistant Professor at the Johns Hopkins Bloomberg School of Public Health, provided compelling testimony in support of phasing out PFAS in Maryland. In her testimony, Dr. Rule emphasized:


"The persistence of PFAS in the human body and the environment means that with every application, we are adding to the human and environmental burden, increasing the amount of PFAS that people are exposed to through food, air, and water. The existing research suggests that exposure to PFAS leads to changes in liver function, increased cancer risks, decreased vaccine responses in children, and other serious health outcomes."


Dr. Rule also pointed out that many healthcare facilities may unknowingly be using pesticides containing PFAS, such as imidacloprid, which has been detected at extraordinarily high levels in recent studies. Her testimony underscores the need for urgent action to eliminate PFAS from healthcare environments to protect the most vulnerable populations, including children and pregnant women.
