A recent article by Burg Simpson shareholders Janet Abaray and David Harman was published in the January 2020 issue of Trial magazine. In 2019, the U.S. Supreme Court decided Merck Sharp & Dohme Corp. v. Albrecht, which provided clarity on the difficult standard drug makers must meet to prove the affirmative defense of impossibility preemption. In their article, Navigating Preemption after Merck, Ms. Abaray and Mr. Harman analyze this decision and provide attorneys with practical guidance on how to develop their pharmaceutical cases and use the Merck case to defeat preemption and simplify the issues at trial.
Janet Abaray, Burg Simpson Ohio's managing shareholder, was interviewed by NPR about a class action lawsuit filed by Burg Simpson against Ambetter Insurance. Ms. Abaray is advocating on behalf of clients who purchased Ambetter insurance policies through the Health Insurance Marketplace and experienced significant problems in obtaining coverage. Plaintiffs discovered that listed providers did not actually accept Ambetter insurance, or that Ambetter had no in-network providers for a particular specialty, or Ambetter was arbitrarily denying claims.
Every December, all of our employees at Burg Simpson Ohio sponsor a family in the Salvation Army Adopt-A-Family program. The Adopt-A-Family program provides local low-income families with much needed items to help brighten their holidays. Burg Simpson employees donate new clothes and toys for families and children who who may otherwise go without during the holiday season.
