David Hersh has been in service to the Arapahoe County Bar Association (ACBA) for many years, serving as its President in 2016 and 2017. Following his tenure as President, Dave has continued to serve the ACBA in various capacities, including as Chair of the ACBA Lawyer Well-Being Committee. Concurrently, Dave serves on the Colorado Supreme Court Lawyer Well-Being Task Force, the Colorado Pilot Project on Well-Being for Legal Employers, and the Wyoming Bar Association Well-Being Committee. Through these public service activities, Dave not only assists individuals in their pursuit of well-being, but he also works to create and enhance a culture of well-being and acceptance in the legal community. 

Colorado Supreme Court Upholds $2.5 Million Award in Construction Defect Case
The Colorado Supreme Court recently ruled not to set aside a lower court's decision that Auto-Owners Insurance Co. cannot intercede in a construction defect case to challenge a homeowner association's uncontested $2.5 million judgment against a glass company. In a 4-3 ruling, the majority said the insurance company was not hurt by the glass company’s pretrial agreement with the homeowner’s association in the construction defect suit.
Trial lawyer Nelson Boyle of Burg Simpson Eldredge Hersh & Jardine PC, who argued for Bolt Factory in the Colorado Supreme Court, commented on the court’s decision: “The Colorado Supreme Court continued to correctly strike a balance between insurance companies and their policyholders. In Colorado, when an insurer breaches its duty of good faith to its policyholder by choosing not to protect the insured from a judgment exceeding coverage, the insured can enter a protective settlement with the injured party. That's what happened here."
