FEDS BLOW THE WHISTLE ON THE RAILROAD FOR ALLEGEDLY CAUSING COLORADO’S 416 FIRE

The U.S. Attorneys Office filed a $25 million lawsuit on behalf of the U.S. Forest Service on July 2, 2019, alleging Durango’s historic railroad started the
416 Fire.
The blaze burned approximately 54,000 acres of land last year in the San Juan National Forest and surrounding areas.
Burg Simpson shareholder, Thomas W. Henderson, and Bobby Duthie of Duthie Savastano Brungard in Durango have also filed a lawsuit against the Durango & Silverton Narrow Gauge Railroad Company and the train’s parent company American Heritage Railways, Inc. on behalf of those in the community who suffered damages. These two firms, who have decades of experience litigating complex cases, have joined forces to protect the citizens of Durango and Silverton and ensure that the train’s owners take responsibility for the harm they caused.
