Fighting for the Rights of Tipped Employees

Burg Simpson shareholder Brian Matise and trial lawyer Travis Riley of the commercial litigation department represent a number of former “tipped employees” who worked to serve customers at a local Denver restaurant.
Beginning in or about 2012, all tipped employees at the establishment were required by management to participate in an arrangement to pool a percentage of their daily tips. The owner mandated that the tips would then be distributed by management to other employees at the end of each working shift
After reviewing the allegations, Burg Simpson concluded that the tip pool arrangement conducted by the restaurant was a willful and blatant violation of the Colorado Wage Claim Act.
Mr. Matise and Mr. Riley are currently seeking redress on behalf of the employees whose tips were stolen from them by their employer and are working to resolve this matter.
In 2021, tipped employees in Colorado now earn $9.30 per hour.
Taking Care of Our First Responders
Burg Simpsons' Workers’ Compensation Division is skillfully led by shareholder and Practice Group Leader Nick Fogel. A significant part of his practice is dedicated to providing legal services to Colorado’s first responders. Nick and his team have many years of experience representing law enforcement, firefighters, EMTs, and paramedics who are injured on the job and in the line of duty. In 2017, Nick was instrumental in passing legislation that made it easier for first responders to receive workers’ compensation benefits related to PTSD. Today, he continues his work with the brave men and women of this community who are experiencing job-related physical and mental health injuries by working to ensure they obtain the workers’ compensation benefits they deserve.

Nick Fogel is on the Board of Directors of the Jeremy Bitner Foundation. This organization provides financial assistance to families of officers killed in the line of duty, and Burg Simpson is proud to sponsor their annual fundraiser every summer. Nick is in the center of the photo above and is joined by some of his fellow board members and officers from the Englewood Police Department.
Nick Fogel has received national recognition by his peers as a Rising Star by Super Lawyers® and Best Lawyers in America®. Under his direction, Burg Simpson's Workers’ Compensation Department achieved Tier 1 status by US News and World Report (the highest-ranking available).
