Burg Simpson Attorneys Win Second Appeal to
Protect $7.3 Million Verdict

After a ten year ordeal that included two trials and two appeals, Burg Simpson shareholder David P. Hersh persuaded the 10 th Circuit Court of Appeals that the conduct of the U.S. Government was responsible for the injuries of our client, the plaintiffs. The government was aware that a sinkhole on their property completely traversed the bike path for at least two weeks before the plaintiff’s bike crash, but chose not to repair it, or warn users that a dangerous condition existed. At issue in this second appeal was whether the Colorado Recreational Use Statute (“CRUS”) 'willful conduct' exception applied. The Tenth Circuit's decision affirmed that it does apply and affirmed the judgment to our clients. The court determined that the “willful conduct” exception to the CRUS prevented the U.S. Government from claiming immunity from suit. For more information about the firms business litigation practice, please click here .

Each year, Burg Simpson awards college scholarships to the graduating high school seniors who win our essay competition regarding the importance of the U.S. civil jury system, and how it is being threatened.

The annual Burg Simpson Scholarship Competition  is an outstanding opportunity for high school seniors to obtain additional funds for college, and to learn more about the significance of our country's civil jury system.
