Medical Malpractice: When There is a Failure to Diagnose


Law Week Colorado  recently published an article i n their annual Personal Injury & Medical Malpractice issue about the failure to diagnose postpartum preeclampsia by Burg Simpson trial lawyers Scott J. Eldredge and Marc C. Johnson .

Fighting the Good Fight
Brian K. Matise, a shareholder and trial lawyer with Burg Simpson’s commercial litigation team, recently prevailed on a jury verdict on all claims for breach of contract and fraud against two different defendants and received a substantial damage award.

The case involved a dispute over title to a residential property. Burg Simpson’s client had leased the property under a real estate contract with an option to buy. Our client lived in the house, made a significant down payment, and complied with all the terms of the contract. When the time came for the other parties to honor our clients’ option to purchase the property, they refused to sign over the title.

The other parties to the case were presented with an opportunity to settle this case last spring for just the title to the house, but they refused. As a result, Mr. Matise fought for his client by taking the case to trial. Subsequently, the jury found in favor of our client, and the verdict included $320,000 in damages for fraud.

Mr. Matise’s legal experience includes all aspects of general civil practice with an emphasis on complex commercial litigation, mass tort product liability litigation, special district and homeowner association law, and insurance coverage litigation. Mr. Matise has successfully tried over a dozen cases to a jury verdict or judgment and obtained several million dollars in settlements for clients.
