FSSA Files Motion to Stay in HIP Case,

Asks for CMS Support


On Friday, July 12, 2024, the Indiana Family and Social Services Administration released an update on the HIP court case.


"The Indiana Family and Social Services Administration filed a motion to stay the District Court’s June 27 ruling in Rose v. Becerra, which vacated federal approval for the Healthy Indiana Plan.


Additionally, this week FSSA sent a letter to the Centers for Medicare and Medicaid Services asking CMS to support the state’s motion and reissue the HIP approval in its entirety if a stay is not granted. The letter also reiterated that the ability to collect POWER account contributions was fundamental to Indiana’s decision to expand Medicaid.


Without a stay or reissuance of the HIP approval, FSSA will be required to start transitioning HIP Plus members to a different benefit package that does not include vision, dental, and other services. The removal of the entire HIP approval also risks the state’s ability to collect the Hospital Assessment Fee, which helps fund coverage for HIP members. Without this funding, it is unlikely the state can continue to provide coverage at the current enrollment, utilization, and reimbursement levels.


The District’s Court’s ruling is far reaching and creates considerable uncertainty for the HIP program. Some implications of the ruling conflict with state law, which could eventually impact the state’s ability to provide health care coverage to the Medicaid expansion group. In addition to addressing the state law conflicts, FSSA will have to make substantial systems and operational changes that will take 12 months or more."


About the Healthy Indiana Plan


The Healthy Indiana Plan provides health insurance for approximately 760,000 Hoosiers or 11% of the state’s population. HIP accounts for nearly 40% of the total Indiana Medicaid enrollment. HIP covers Hoosiers ages 19 to 64 who meet specific income levels.

Keeping Medicaid Beneficiaries Continuously Enrolled


During the pandemic, Congress suspended Medicaid redetermination so people would not have to worry about losing their coverage. But since states resumed processing renewals, “enrollment churn” has rebounded, with many eligible adults losing their coverage only to regain it later.


George Washington University’s MaryBeth Musumeci says that while new federal regulations should reduce Medicaid churn, ensuring continuous eligibility for a year or more would further stabilize coverage and limit administrative costs.

2024 ILEARN Scores


The 2024 ILEARN scores released Wednesday showed slight changes from last year’s scores.

Statewide test scores for all Indiana students in grades 3 to 8 show less than a half of a percentage point change for the percentage of students proficient or better in English language arts, math and the subjects combined.



Scores went up slightly for the subjects combined and for English, but down slightly for math.

A&D and TBI Waiver Update


The Family and Social Services Administration (FSSA) has released guidance to Hoosiers who received services on the former Aged and Disabled or the Traumatic Brain Injury waivers.

Marketplace Training


In preparation for the release of the 2025 training, the Marketplace Learning Management System (MLMS) was taken offline on July 12th. The 2025 training is expected to be live later this summer. 

New FSSA Fax Number


FSSA is asking for assistance in spreading the word about the new fax number. Documents can be submitted at local DFR offices, via the Benefits Portal, or by faxing 888-436-9199.

Assistance for the Children of Veterans


Operation Back to School provides $500 for back-to-school expenses for dependent children of Veterans with income at or below 200% of the federal poverty guidelines. Families will receive $500 for each child/dependent in K -12 and full-time college students up to age 23. Deadline for applications is August 30th.

Beyond the Basics updated their Health Insurance Affordability Programs’ Eligibility Based on Immigration Status information sheet. It reviews eligibility for Medicaid and CHIP as well as Marketplace and is available in English and Spanish.

The Centers for Medicare & Medicaid Services (CMS) released an infographic, 2024 Medicaid & CHIP Beneficiaries at a Glace: Autism. It covers the prevalence of autism, reported health and functional status for children with autism, and more.

Special Populations


The Centers for Medicare & Medicaid Services (CMS) offers resources to help assisters reach special populations including those who are underserved and underinsured. Informational documents are available for those serving individuals who are justice-involved, homeless, immigrants, veterans, and others. The resources include presentation slides and information in multiple languages.

CATCH My Breath


To support tobacco/vaping prevention efforts, Indiana Department of Health, Tobacco Prevention & Cessation (TPC) has partnered with CATCH to offer free CATCH My Breath trainings this fall – three Implementation Trainings and four Train-the-Trainer Trainings.

 

CATCH My Breath is a free, evidence-based youth vaping prevention program with published evidence of reducing students’ likelihood to vape. Aligned to national and state education standards, CATCH My Breath can be taught by individuals who serve youth in grades 5-12, including educators, local and state government agencies, public health specialists, and community volunteers.

The Connecting Kids to Coverage national campaign is hosting a Back to School webinar to discuss how Medicaid and CHIP coverage helps students be ready for the new school year.
