The New Paycheck Protection Program Loan Forgiveness Application
The PPP Loan Forgiveness Application -- changes/highlights:
- 8 week coverage period begins with day of deposit OR can begin with next payroll period after loan is deposited.
- Payroll costs can be incurred within 8-week period, as long as paid on or before next payroll date.
- Non-payroll costs (25% maximum) must be paid or incurred within the 8 weeks, as long as paid before the next regular billing date.
- FTE calc is based on a 40 hour week. Part-timers can be calculated on actual % of 40 hours or, for simplicity, as .5 for each worker.
- Loan forgiveness is lesser of: % reduction of FTE’s multiplied by actual payroll and non-payroll costs, then compared with % of payroll costs to the 75% requirement, multiplied by loan amount. (low FTE’s will hurt since it will further reduce allowable total costs)
- FTE safe harbor: no % FTE reduction if FTE’s on June 30, 2020 are same or greater than FTE’s on Feb 15, 2020
- Application and documentation is due to your bank between July 1 and October 31.
There is talk in DC about extending the 8 weeks to perhaps 24 weeks, and reducing the 75% payroll costs requirement…..stay tuned.

Workers Get Presumption for COVID-19
California Gov. Gavin Newsom has issued an executive order requiring that workers who either test positive for COVID-19 or are diagnosed by a physician as having coronavirus are eligible for workers’ compensation benefits. The order means that it will automatically be presumed that the employee contracted the virus on the job if they test positive or receive a diagnosis within 14 days of their last shift.Additionally, the employee must have been working at a worksite and not from home to qualify, and the diagnosis must be confirmed by testing within 30 days of the original diagnosis.
