Colorado needs more affordable and attainable housing options and legislators can act now to address this challenge. SB24-106 - Right to Remedy Construction Defects - addresses right-to-remedy, informed consent, and negligence per se.
These much-needed reforms will help decrease insurance costs, ensure homeowners have the right to pursue timely remedies, provide a faster path for resolution, and give homeowners greater transparency about construction litigation related to their property.

Homeownership rates for racial minorities increased in 2022, with Asian and Hispanic Americans achieving historic peaks.2 Despite these advancements, disparities persist among racial and ethnic groups, notably with Black homeownership lagging. People of color continue to endure significant buying challenges throughout and after their home purchases, according to a report released today by the National Association of Realtors®.

CAR Supports: HB24-1107 Judicial Review of Local Land Use Decision
Sponsors: Rep. Lindstedt and Sen. Bridges
Local governments have land use and planning authority in the State of Colorado. HB 1107 requires attorney fees be awarded to prevailing government entities in decisions involving residential use and protects local land use decisions as valid when judicial review is pending.
Advocacy groups have increasingly challenged the land use decisions of local government elected officials through legal proceedings and hold back the development of projects, especially housing development. Local governments stand to reduce litigation costs related to civil actions filed in opposition to their decisions. CAR is monitoring the bill because it evens the field for governments exercising their quasi-judicial authority, ensures residential projects are built on time, and it protects the public resources of a local jurisdiction.
