UI APPEALS RESULTS BY STATE
UWC - Strategic Services on Unemployment & Workers' Compensation recently reported that data on UI appeals results by state at the lower level of appeal have been compiled by US DOL for calendar year 2013 and show significant differences across states. 


The report tracks the number of appeals and the percentage of the time that claimants and employers prevail on appeal.

 

The states in which claimants prevail at lower level hearing the highest percentage of the time include:  

  • DC 
  • CA 
  • FL 
  • MA 
  • NH 
  • MI

States in which claimants prevail at lower level hearing the lowest percentage of the time include:  

  • NE 
  • AR 
  • VA 
  • DE 
  • TN
  • UT

State in which employers prevail at lower level hearing the highest percentage of the time include:  

  • MS
  • NC 
  • DE 
  • TN 
  • WA 
  • SD

States in which employers prevail at lower level hearing the lowest percentage of the time include:  

  • OR
  • UT
  • CT
  • DC
  • WI
  • IL
  • NY

These results track whether an appellant is successful on appeal and do not measure the success rate on appeals in general. For example, it does not track whether an employer may prevail in an appeal brought by a claimant or whether a claimant may prevail in an appeal filed by an employer. However, these result provide some indication of whether an employer or claimant may prevail when deciding whether to appeal.
