West Virginia Governor, Jim Justice appointed Equity Member, Jordan Herrick, as a Commissioner for the West Virginia Ethics Commission. The Ethics Commission is charged with investigating, initiating, processing, and adjudicating Complaints of potential violation of the West Virginia Ethics Act.
The Commission also drafts and issues formal Advisory Opinions regarding the Ethics Act and the Open Governmental Meetings Act; administers the registration and reporting of lobbyists and publishes an annual directory of lobbyists; processes Financial Disclosure Statements for candidates and other public servants who are required to file; responds to inquiries from the media and the public regarding lobbyist registration, Financial Disclosure Statements, and the general interpretation of the Ethics Act; and, interprets the Open Governmental Meetings Act.

The Wheeling office successfully defended the Marshall County Commission, the Sheriff’s Department and one of its officers in Wood v. Johnson, et al., Civ. A. 5:23-cv-143. Plaintiff in that matter alleged that her constitutional rights were violated because she was bitten by a K-9 while she was hiding from officers serving a warrant against her.
The United States District Court for the Northern District of West Virginia found that qualified immunity protected Defendant Johnson from suit, and that even if it did not, the force used was not constitutionally impermissible. The Court further found that Plaintiff did not establish a Monell claim against the Commission. Plaintiff’s appeal time has run and the decision is now final. Thomas E. Buck and Benjamin P. Visnic successfully represented the defendants in this matter.

Of Counsel, Albert C. Dunn, Jr. (Abbie) of the Charleston office defended a funeral home in a case wherein the siblings and their husbands have sued contending that the funeral home deviated from the standard of care in not preventing an interment service from being performed in a manner deemed appropriate by the cemetery with which the plaintiffs had a contract with, claiming emotional distress damages.
The Court granted the funeral home’s Motion to Dismiss three of the four Plaintiffs’ claims for lack of standing.
