Town responds to updated application materials from applicant for 95 Broadway Project

On November 22, 2025, the Town of Fairfax issued a response letter to the applicant regarding the proposed 95 Broadway mixed-use project. The correspondence follows updated application materials submitted on November 14, 2025.


The Town’s response provides a conditional approval for the project, listing pages of conditions that the developer will need to meet in order to complete building permits. Among the conditions are approval through the Fire Department, Sewer and Water Districts, regional and state agencies.


The Town is obligated to comply with state law. To provide input to your lawmakers at the State level: Find Your California Representatives and Contact the Governor | Governor of California.


There is significant risk in denying a housing project in California. The California Department of Housing and Community Development and the California Attorney General’s office have the opportunity to file litigation, and have filed litigation in other jurisdictions, challenging denials of housing development projects. Additionally, Public interest housing-advocate groups can join or bring parallel lawsuits when a housing project is denied. Even if the applicant settles with a city, the State can continue the litigation. Furthermore, the applicant, the State, and the housing-advocate groups can all claim extensive attorney’s fees and costs (including expert-witness and consulting fees). Fees and costs are frequently awarded even if they prevail on only one claim out of several. The cost to cities can be staggering.


Left with no alternative, the Town reluctantly provided the conditional approval, with pages of conditions of approval on the project. A letter notifying the applicant of the Town’s approval, along with a list of all required conditions for the approval to be effective, was sent to the applicant on November 22, 2025.

State Audit Confirms Fairfax in Full Compliance With Transportation Funding Requirements

The California State Controller’s Office has completed its audit of Fairfax’s state transportation funds for FY 2023–24, issuing a clean audit with zero findings.

 

The review confirmed that the Town correctly managed and documented all Special Gas Tax Street Fund and SB 1 (Road Maintenance & Rehabilitation Program) expenditures, using every dollar solely for eligible street and road improvements.

 

As part of this review, auditors also conducted a 20-year reconciliation (2003–2024) of the Town’s transportation fund balances, confirming accurate year-to-year accounting and long-term compliance with state financial standards.

  • $405,000 in transportation expenditures reviewed
  • No errors or compliance issues identified
  • $188,842 remaining in the fund, reserved for upcoming road projects

Help shape Fairfax’s Bicycle & Pedestrian future - Walk audit recap, survey, and upcoming meeting

On November 16, BPAC members, Town staff, and residents completed a 1.5-mile walk audit to assess connectivity and safety along key routes between the Library, Broadway/Center, Good Earth, and Sir Francis Drake Boulevard. Participants used AARP’s walk audit worksheet, and their findings—along with results from additional autumn and winter engagement activities—will be presented at the January 22 BPAC meeting.


Community input is essential to the 2026 update of Fairfax’s Bicycle and Pedestrian Master Plan. Please take a few minutes to complete the Town’s map-based walking, biking, and rolling survey and share your real-world experiences.

Fairfax–Bolinas Road Slide repairs ongoing through 2026

Marin County Public Works will begin stabilizing two slide areas along Fairfax–Bolinas Road near Fresa Avenue and Meadow Club Road. Construction will continue through January 2026, with one-lane traffic control and brief delays (up to 5 minutes) in place 24/7.


Work will pause on major holidays to minimize impacts.

Ross Valley Fire Department Annual Toy Drive

The Ross Valley Fire Department is once again collecting toys to help ensure that children in our Ross Valley communities have a bright and joyful holiday season.


Community members are invited to donate new, unwrapped toys at any RVFD fire station, including the Fairfax station, throughout the collection period.

Monitoring H5 Viruses Locally

The first confirmed human case of avian influenza A (H5N5) in the U.S. has been reported in Washington State. Meanwhile, in Marin County, the wastewater-surveillance system continues monitoring for H5 and other respiratory viruses, and our local risk remains low. Residents are urged to wash hands regularly, wear masks in crowded indoor settings, avoid unpasteurized dairy, and not handle sick or dead birds. If you observe unusual bird deaths, contact the appropriate health or wildlife authorities. As we continue to march through respiratory season, now is the perfect time to get both your flu vaccine and COVID-19 vaccine. 

  

Marin County BOS Passes Tobacco Ordinance 

The Marin County Board of Supervisors officially passed a minimum tobacco price and vape sales ban to reduce youth access to nicotine products and promote health equity in the unincorporated areas of Marin. The ordinance includes (1) a $12 minimum price for tobacco and nicotine products, (2) a ban on vapes and heated smoking devices, (3) an end to coupons and discounts, and (4) a $1 automatic price increase every two years starting 9/1/2026.
