White House Executive Order Clarifies Tariffs

The White House issued this Executive Order providing for the duty rates for countries under his reciprocal tariff efforts under IEEPA. What you need to know is: shipments loaded on vessel and in final mode of transit before midnight ET on today and entered for consumption before midnight ET on 10/5/2025, will still have a 10% reciprocal tariff. Shipments loaded on a vessel and in final mode of transit before midnight ET today and entered for consumption on and after midnight ET 10/5/2025, will have a country-specific rate listed in Annex I. Finally, shipments loaded on vessel on and after midnight ET today will have a country-specific rate listed in Annex I. Countries not listed in Annex I will be subject to a catch-all 10% reciprocal tariff.

Effective July 9, 2025, the FDA has ended de minimis exemptions for five product categories—meaning full ET86 data submission is now required for shipments of cosmetics, dinnerware, radiation-emitting devices, biological samples, and many packaged food items.

This change reflects growing concerns about e-commerce volume, safety oversight, and the commercial use of low-value imports.

Transpacific Rates Trend & Market information

There is no sign of a peak season here, and this week’s announcements of reciprocal tariff rates being imposed by President Trump at varying percentages with seemingly little underlying economic data to correlate isn’t helping.

Bookings have been getting soft since July, and the carriers expect volumes to weaken through Q3 or even Q4, as shippers have frontloaded much of their seasonal freight. With the new US tariff rates, the cargo demand is expected to further dampen, particularly for smaller cargo owners and those shipping low-value goods who may have to reduce orders or stop shipping entirely due to higher tariffs making the buying cost uneconomical and seemingly the end of the United States de minimis program as is currently constructed. 


Capacity utilization on Transpacific services have continued to fall and are now at their lowest level since April. LINERLYTICA reported in the latest weekly newsletter that the capacity utilization on both USWC and USEC may drop to only 85% this week, and “US tariffs have already spurred higher inflation and slower job growth which will lead to slower demand growth in the 2nd half of 2025”. Capacity management can be the only 'weapon' used by carriers to push up spot rate. The question on everyone’s minds, though, is how much capacity management can they actually do – or worse, take out of service – to stabilize load factors where they want them to be.


Even in a capacity-constrained environment, there is still demand forecasted for the holiday season. Therefore, a sharp drop in cargo volumes and spot rates in August, could be followed by a short-lived boom toward the second half of September, especially with factory shut-downs in China during Golden Week during the first week of October. Again, with effective capacity cut by carriers, there might be sudden sharp rises for two or three weeks, and equally rapid downturn after that.

Pursuant to the General Notice (90 FR 34665) published July 23, 2025, adjustments to certain customs user fees and corresponding limitations, as codified in 19 U.S.C. § 58c, will take effect on October 1, 2025. These adjustments are being made in accordance with the Fixing America's Surface Transportation Act of 2015 (FAST Act), Public Law 114-94.


The Merchandise Processing Fee (MPF) ad valorem rate of 0.3464% will NOT change, but the MPF minimum and maximum for formal entries (class code 499) will change.


The administration has set its sights on Brazil and India, subjecting them to additional tariffs above the announced reciprocal ones.


Brazil is receiving an additional 40% tariff, bringing the total reciprocal level to 50%.


India was facing an additional 25%, but the President cited the country’s purchase of Russian oil as a reason to impose an additional 25% later in the month. There are exceptions for certain commodities from Brazil, and India’s additional duty doesn’t begin until August 27th, but the country shows no signs of backing down.
