Good Morning Folks,

Coachella Valleys Multiple Species Habitat Conservation Plan Local Development Mitigation Plan

This week we are starting with a proposal from the Coachella Valley Conservation Commission. Previously we shared that we had been contacted by staff regarding the draft fee study being ready for our review. For years we have asked to be part of the draft process with an opportunity to advise regarding its legitimacy pursuant to the Mitigation Fee Act.

The Desert Valleys Builders Association (DVBA) has been a longstanding supporter of the Coachella Valley Multiple Species Habitat Conservation Plan (CVMSHCP) and the Local Development Mitigation Fee Nexus Study. However, the current proposed update raises significant concerns, particularly regarding compliance with the Mitigation Fee Act.

Firstly, it introduces a new requirement to purchase Fluvial Fan acreage without clear justification, questioning its developability and whether existing regulations impede development in these areas.

Secondly, the appraised land values in the study do not reflect actual market conditions, as they neglect a comprehensive historical analysis of sales.

Lastly, the annual habitat conservation targets are unduly constrained by the willingness of property owners to sell, and the success of the plan should not be judged based on limited availability.

The DVBA asserts that the update lacks the necessary connections required by the Mitigation Fee Act and related federal case law. Consequently, it cannot support the proposed update unless these fundamental issues are addressed.

Professional Women in Building

Our ladies, Professional Women in Building Council, canceled the August council meeting. Instead, they held a networking happy hour mixer at La Fe Wine Bar on El Paseo in Palm Desert. It just so happened that the Ladies’ Leadership group (I apologize as this is likely not the organization’s name) was doing the same thing.

The PWB had at least 15 members and guests, with the Ladies' Leadership group having nearly the same. It was a wonderful opportunity for both organizations to share their ideas and commitments to support women, the young, and the mature. It was also an opportunity for some to relax and get to know each other on a personal level. The Coachella and Imperial Valleys traditionally work on personal connections first and foremost. They support DVBA’s commitment to do business with members when possible

Power Play

Caterpillar’s 26Q2 earnings were superb. The AI boom continues to drive demand for its engines and generators, while construction activity boosts demand for dump trucks/bulldozers/excavators. Quarterly revenue hit an all-time high, it raised full-year sales guidance, and its backlog is up 92% Y-o-Y. Cat plans to double production of turbine engines by 2030 and invest to make more generators. This is proof AI demand for power and energy is insatiable.

Bill Tracking:

California lawmakers returned to Sacramento on Monday, August 3, 2026, from their month-long summer recess. They face a high-pressure final month tackling over 1,200 pending measures before the August 31 adjournment of the 2026 legislative session, with heavy focus on fiscal committee hearings and end-of-session policy packages.

Key Focus Areas and Legislative Fights

  • Disaster & Insurance Packages: Lawmakers are reviewing potential last-minute proposals tied to a recent California Earthquake Authority study regarding wildfire risk reduction and property insurance costs.
  • Education & Social Media: Bills remain active concerning school finance, substitute teachers, responsible AI/social media literacy in schools, and restrictions on addictive features for minor accounts on online platforms.
  • Deadlines: Fiscal committees like the Senate Appropriations Committee are rapidly vetting bills to move them to the floor ahead of the final August 31 adjournment. Bills passed by then go to Gov. Gavin Newsom, who has until September 30 to sign or veto them.
