On Thursday, the U.S. Supreme Court issued a stay against the federal OSHA’s vaccine-or-test mandate for businesses with 100+ employees in NFIB v. OSHA. The Court’s ruling did not decide on the constitutionality of governmental vaccine-or-test mandates, but rather the Court ruled that Congress had not authorized OSHA to enact such a mandate. The Court also ruled Thursday in Biden v. Missouri that the U.S. Secretary of Health and Human Services can move forward with a vaccine mandate for health care workers in places that accept Medicare or Medicaid (Medi-Cal in California) because laws previously passed by Congress gave the HHS Secretary authority to do so. The rulings do not affect any of the Cal/OSHA mandates.

With a decision issued last month and then certified last week, the California Court of Appeal has upheld Cal/OSHA’s testing and masking mandates. Cal/OSHA has not imposed a vaccine mandate. A placeholder item on the agenda for tomorrow’s Cal/OSHA Standards Board was placed pending the U.S. Supreme Court ruling on the federal OSHA standards. The Cal/OSHA Standards Board has not filled the placeholder item, and it appears that Cal/OSHA will not be issuing a vaccine-or-test mandate at this time.
