Coronavirus (COVID-19) Update: FDA Limits Use of Janssen COVID-19 Vaccine to Certain Individuals
The U.S. Food and Drug Administration has limited the authorized use of the Janssen COVID-19 Vaccine to individuals 18 years of age and older for whom other authorized or approved COVID-19 vaccines are not accessible or clinically appropriate, and to individuals 18 years of age and older who elect to receive the Janssen COVID-19 Vaccine because they would otherwise not receive a COVID-19 vaccine.

Walgreens, Florida Settle Opioid Costs Lawsuit for $683 Million
Walgreens has settled with Florida in a lawsuit that accused the pharmacy chain of fueling the opioid crisis, Attorney General Ashley Moody announced on Thursday.

The suit that wrapped up in Pasco County also concludes several years’ of state litigation against opioid manufacturers, distributors and pharmaceutical companies.

Walgreens agreed to pay the state $683 million, most of which will be paid out over the next two decades, with a smaller portion going toward legal fees. The funds bring the total Florida has collected from opioid lawsuits to more than $3 billion.

A Year in Review: Physician Perspective on Information Blocking Regulations
Over a year has passed since the Information Blocking compliance date (April 5, 2021). Several critical components necessary for physicians to fully comply with the regulations are still missing. These include a final set of regulations from The US Department of Health and Human Services’ (HHS) Office of Inspector General (OIG) and HHS policies on provider Actor disincentives. Yet, all Actors subject to HHS’ Information Blocking regulations (i.e., providers, EHR vendors, and health information exchanges), have been required to comply since April of last year. The AMA continues to engage with HHS and is pushing for more clarity and flexibility on a range of Information Blocking requirements. Still, EHR vendors are Actors under HHS regulations and therefore must not prevent the access, use, or exchange of electronic health information.

Examples of EHR vendor information blocking include:
  • A physician partnered with a third-party application developer to conduct data analytics that required access to EHR data. The physician and partner developer sought to make data access arrangements with an EHR vendor. The EHR vendor indicated access to patient data would be limited by number of patients per request and frequency of requests.
  • A medical practice seeks to implement a third-party population health application. Their EHR vendor notes that it is only required to provide a limited amount of data. Access to additional data will require a customized EHR solution and will be subject to consulting fees.
  • A patient seeks to access her entire medical record from their EHR patient portal. The request is made by the patient, however the EHR cannot support the request. The physician is targeted as an “information blocker”. The physician requests support from their EHR vendor who refuses unless additional fees are paid. 
In conjunction with Information Blocking regulations, EHR vendors:
  • Cannot not block or charge excessive fees to connect physicians to clinical registries or health information exchanges.
  • Must allow physicians to publicize concerns with EHR performance, costs, and patient safety.
  • In general, cannot charge excessive fees and may only seek “reasonable profit”. 
  • Cannot use contracts, technical limitations, or fees to restrict physicians from migrating between EHR products. EHR vendors must provide support during a product migration.  
  • Must support application programing interfaces (APIs) and allow physicians to use applications created by non-EHR vendors.
  • Cannot knowingly block physician access to patient medical records.
The AMA is reaching out to better understand physicians’ experiences with Information Blocking compliance, issues physicians have encountered when requesting information from other Actors (e.g., their EHR vendors, state health information exchanges, or other providers or hospitals), and specific examples of EHR vendors preventing access to patient health information. We welcome any examples or anecdotes you wish to share. The AMA will compile, deidentify, and share your example stories with HHS officials and advocate for increased focus on information blocking practices that prevent or inhibit physician access to patient information.   1. What are your top three concerns or challenges complying with HHS’ Information Blocking regulations?
  2. What are the top three issues you have experienced when requesting patients’ electronic health information from another Actor, e.g., your EHR vendor, local hospital, laboratory/pharmacy, or another medical practice?
  3. What are the top three features/functions you wish your EHR had to help you comply with HHS’ Information Blocking regulations?
  4. What other information blocking issues or experiences would you like us to share with HHS?

Join Leon County Government for “Celebrating Life, Understanding Death: A Six-Part Series” every Thursday from April 21 through May 26 at 6 p.m. at the Dr. B.L. Perry, Jr. Branch Library. Each week of this series features compassionate professionals who will speak about different aspects of death and dying.
 
From religious, spiritual, and physiological practices associated with the care of the dying, to the more practical matters of funeral and will planning, to the tender ways in which we support those who grieve, attendees will engage in meaningful conversations about a journey we will all one day make.

The panel will be moderated by Rev. Candace McKibben.
  • Understanding the Dying Process and Debunking Hospice Myths, Thursday, April 28 – Cristal Baer of Covenant Care and Dr. Richard Zorn will discuss what happens to the body during the dying process and share information about hospice care, including what services are provided and when hospice care starts.
  • Starting the Conversation: Advance Directives and Wills, Thursday, May 5 – Paul Malley, president of Aging with Dignity, and elder law attorney Kandace E. Rudd will discuss advance directives for medical care and wills for distribution of personal property. Attendees will receive a free copy of the Five Wishes document, which helps adults consider and document how they want to be cared for at the end of life.
  • How to Live with Grief and Supporting Children through Loss, Thursday, May 12 – Melanie Pelc, president of The Living Room, and children’s grief counselor, Caitlin Burns, will discuss strategies for coping with grief at all ages and how to support children through loss.
  • Funeral Planning and Legacies, Thursday, May 19 – Funeral director Linn Ann Griffin and pre-planning counselor Sarah Taylor will discuss what to expect when planning a funeral and different burial options, including green burials, cremations, aboveground entombment, and in-ground burials.
  • Sitting with the Dying: Rituals and Care at the Bedside, Thursday, May 26 – Kamala Snow, manager of spiritual care at Big Bend Hospice, will discuss what to expect in the final days, hours, and moments, and how we can bring meaning to the time we have left together. Then members of the Tallahassee Area Threshold Singers will discuss and demonstrate how they bring comfort through song to individuals and their loved ones at challenging thresholds of living and dying.

Florida E-Prescribing
Electronic Prescribing Requirements (Florida Board of Medicine)
House Bill 831 (2019), Electronic Prescribing, was signed into law by Governor DeSantis. The effective date is January 1, 2020. The bill provides important new requirements for prescribers to generate and transmit all prescriptions electronically upon licensure renewal or by July 1, 2021, whichever is earlier.

PAP Machine Donations Needed!
A PAP (Positive Airway Pressure) machine is an electronic respiratory ventilation device used to treat obstructive sleep apnea. Capital Medical Society Foundation, Inc.'s We Care Network program assists low-income, uninsured adults, whose income is at or below 150% of the Federal Poverty Level, with obtaining these potentially life-saving medical devices, when prescribed by a pulmonologist. Thanks to our partners at Desloge Home Oxygen and Medical Equipment, Inc., we are able to provide refurbished CPAP, AutoPAP, and BPAP machines for eligible We Care Network patients in Leon, Gadsden, Jefferson, and Wakulla Counties. We Care Network also accepts unused, unopened supplies for PAP machines, such as masks, nasal cannulas, and tubing. We Care Network coordinates over $8,000,000 in donated specialty medical and dental care annually.
 
Machine donations can be dropped off at Capital Medical Society Foundation's office at 1204 Miccosukee Road, Tallahassee, FL 32308.
