ICE Updates Form I-9 Requirement Flexibility to Grant Employers More Time to Comply with Requirements
The U.S. Department of Homeland Security (DHS) and U.S. Immigration and Customs Enforcement (ICE) announced that employers must comply with Form I-9 requirements within 30 days after the COVID-19 flexibilities end on July 31, 2023.
The flexibilities allowed remote document examination during the pandemic, and employers now have until the end of August 30 to complete physical inspections for employees hired since the start of the pandemic.
What this means for employers:
- Employers will have 30 days to reach compliance with Form I-9 requirements after the COVID-19 flexibilities sunset on July 31, 2023
- Physical inspections of identity and employment documents must be completed by August 30, 2023, for employees hired since March 20, 2020.
- DHS plans to issue a final rule later this year for alternative document examination procedures after reviewing public comments.
