Colorado Construction Defects Reform Efforts

Six years after construction-defects reform advocates passed a bill and won a key legal ruling that they believed would restart the state’s dormant condominium-building market, it’s become clear that the changes were not enough. And, so, the reform debate will be returning to the Colorado Legislature in 2024. The reformed Homeownership Opportunity Alliance — a coalition that includes homebuilders, construction groups and economic-development organizations — is pushing a two-tiered proposal that it believes would reduce the number of lawsuits filed against new condos. That, in turn, would bring more insurers back to the market, cut insurance costs and make it more feasible for builders to put up the lower-cost housing if their construction costs fell substantially, backers say. A pair of moderate but influential members of the majority party at the Capitol are signed on to run the bill, and Sen. Rachel Zenzinger, D-Arvada, said this will be her pre-file bill, meaning it’s likely to begin its legislative journey early in the session. Its biggest opposition likely will come again from plaintiff attorneys who long have argued that people who invest their life savings in a poorly built home must have the right to seek redress in court — though supporters insist they are crafting the legislation in a way that will reduce lawsuits without granting blanket immunity.

Questions Surround New Rules

Colorado officials are closing in on two key deadlines for their new Family and Medical Leave Insurance program and continuing to finalize rules for how the program will work, leaving both business and worker-advocacy groups with questions that they hope to have answered quickly. Voters approved creation of the FAMLI program in 2020, allowing any Colorado worker to take as much as 12 weeks of partially paid leave each year to be with newborns or adopted children, care for themselves or family members with serious conditions or escape domestic violence. State officials began taking deductions from employers and from employees’ paychecks in January to fund the expected $1.2 billion program, and workers can begin taking their leave, if approved by the FAMLI division, at the start of 2024. Employers can choose to participate in the state-run insurance pool or to create or purchase private insurance plans that must offer benefits as generous as state requirements but that will let plan administrators make decisions on approving or denying leave. Those who want to operate such private plans have until Tuesday to submit an application to the FAMLI division of the Colorado Department of Labor and Employment and, if approved, be refunded for the fees they have paid into the program since the start of the year.

FTC Should Protect Consumers

The Federal Trade Commission’s fake review rule will help protect consumers from being duped and strengthen businesses’ brand integrity. Here’s how the Chamber thinks the agency can improve it.. You’ve likely fallen for fake online reviews. Something which is unfortunately all too common. Now though, the Federal Trade Commission (FTC) is considering a proposal to penalize businesses who engage in this deceitful practice. The FTC proposed a rule that prohibits businesses from buying or selling fake consumer reviews, testimonials, and indicators of social media influence. The proposed rule prohibits businesses from incentivizing positive or negative reviews, threatening people to prevent or remove negative reviews, or suppressing negative reviews. The rule also prohibits reviews by employees or “insiders” without disclosing the connection to the company.

Social Responsibility

Alarming Trend Needs Robust Response

Communities and businesses across the U.S. are facing a historic increase in crime, an alarming trend requiring a robust response. The rising crime problem is affecting both small businesses and large retailers and warrants a serious response from policymakers. A new report from the U.S. Chamber of Commerce highlights the surge in retail and related crime and commends progress in the fight while outlining needed policy actions from local, state, and national lawmakers. “The scourge of organized retail crime has become increasingly pervasive, with retailer losses driven by retail crime totaling nearly $100 billion dollars last year," said Tom Wickham, the Chamber's senior vice president of State & Local Policy. "No store should have to close because of theft, but we are sadly seeing more stores – particular smaller ones – shuttering their doors because of theft and other crime in their neighborhoods.”  The report, “Crime Risk to Business 2023,” includes a new survey of corporate documents from January through August 2023 that show mentions of organized retail crime by companies listed on the S&P 500 already surpass those recorded last year by 43%. An earlier U.S. Chamber of Commerce survey of small businesses found that as many as 56% of small businesses reported theft, with 53% of small businesses saying that the problem has gotten worse. At the aggregate level, the National Retail Federation (NRF) reports that as much as $100 billion has been lost to general crime, or shrink, in the past year, and that organized retail crime—or crime perpetrated by organized criminal rings—continues to rise, with 26.5% of businesses reporting an increase in organized retail theft.
