Five Drugs Get Affordability Review

Two years into existence, Colorado’s Prescription Drug Affordability Review Board on Friday selected its first five drugs to undergo an affordability review — including one that doctors, patients and its pharmaceutical manu-facturer pleaded to keep out of the first-of-its-kind process. The selection of the drugs — two of which treat psoriasis and one each that treats HIV, a range of autoimmune diseases and cystic fibrosis — does not mean that the board will automatically seek to cap the prices for which they can be sold in Colorado. Officials with the Colorado Division of Insurance now will undertake studies that will help the board to determine if the drugs are unaffordable, and if they are, the board will have to take a further step and decide whether it wants to impose an upper payment limit on the pharmaceuticals. But after years of deliberation and a narrowing process produced a quintet of drugs from a list of 604 prescription drugs deemed eligible for review because of their high prices and significant annual increase in costs, the board took what was arguably its first major action. Now consumer advocates and bioscience leaders will watch the next steps closely to see just how far the appointed board is willing to go to try to curb the hike in pharmaceutical prices that legislators and Gov. Polis have cited as a major cause of health-care unaffordability.

One Stop Sales Tax Remittance

Colorado is spending millions of dollars to boost its underutilized one-stop sales-tax remittance portal, undertaking changes that will make it easier for businesses to use the system and funding a public-awareness campaign to educate employers who haven’t yet signed up for it. And the efforts to increase use of the three-year-old Sales and Use Tax System may not stop with carrots to the business community. A prominent state senator suggested during an interim committee meeting Tuesday that he may run a bill to exempt employers from having to remit sales-tax revenues to cities that have yet to agree to sign onto the statewide portal. The moves are necessary, several members of the legislative Sales and Use Tax Simplification Tax Force said, because the uptake on the portal has fallen short of what legislators hoped it would be when they spent $8 million to build out the system. After the U.S. Supreme Court declared in 2018 that state and local governments can require out-of-state e-tailers to remit sales-tax revenues for products sold to their residents if the filing requirements are not overly complex, Colorado built SUTS to capture revenue both from out-of-state internet giants and from local businesses that hadn’t been reporting local sales.

Complex Changes To Auditing Standards

Auditors help to ensure investors have accurate information to make informed investment decisions. Now, however, the body that oversees the practices of public auditors, the Public Company Accounting Oversight Board (PCAOB), is proposing to completely alter financial reporting. Through proposed changes to auditing standards known as NOCLAR (Noncompliance with Laws and Regulations), the PCAOB would degrade audit quality, harm investor protection, make the audit process considerably more complex, and increase the cost and scope – without a clear benefit to investors. The Proposal outlines a series of complex duties, without adequate justification, that are not encompassed within the audit and therefore are beyond the remit of the PCAOB. The new PCAOB proposed standards would drastically expand the scope of the auditor’s responsibility to matters well outside the auditor’s traditional role.
