AB 1808 - Childcare and Development Services: Eligibility

Author: ASM Stephanie Nguyen

Assemblymember Nguyen served as the Executive Director of Asian Resources, Inc. (ARI) to ensure that all communities, especially the low-income, immigrant, refugee, limited English-speaking youth, formerly incarcerated and undocumented, have access to support and services to help them get one step closer to self-sufficiency. She was elected to the Elk Grove City Council in 2017 and is the first Asian American woman in this role.

Stephanie Nguyen has lived, worked, and served the Sacramento and Elk Grove communities almost all her life. The daughter of Vietnamese Refugees who fled the Vietnam War by boat, she grew up in Sacramento’s Little Saigon district and attended Sacramento schools before graduating from Sacramento State University.

Child Care Q&As

Question: Will center-based providers receive a transitional one-time payment in parity with family child care home providers?

Answer: Funds to support Transitional One-Time Payments to center-based providers are expected to be issued in Spring 2024. 

Question: How long will the monthly cost of care plus rates be distributed?

Answer: Providers serving children enrolled in all setting types of the programs identified above (License/License-Exempt Family Child Care Homes and centers) will be eligible for the Monthly Cost of Care Plus Rates payments from January 2024 through June 2025. 

Federal Update

Federal Government Update:

Late last week, Congress’s top appropriators reached a deal on the totals for a dozen FY24 spending bills, clearing a critical hurdle toward securing a broader government funding agreement before federal cash expires for a swath of agencies in less than five weeks.

Senate Appropriations Chair Murray (D-WA) and House Appropriations Chair Granger (R-TX) reached the deal late Friday night. Both sides aren’t releasing the numbers for the 12 funding bills, which will provide federal agencies with updated budgets for the current fiscal year. It is critical that we continue to make the case that FY24 appropriations and any additional funding considered by Congress includes our ECE priorities. 

⇒ Please urge your Members of Congress to protect and expand funding for child care and early learning programs.

Our country needs Congress to push past the chaos and focus on the basics: keeping the government running and passing funding bills that place the needs of women, families, and children first. 

UPDATE: Child Tax Credit

This week, the House passed the bipartisan Tax Relief for American Families and Workers Act―the tax package that includes an expanded Child Tax Credit (CTC)―and now it’s on to the Senate. More: NWLC Statement on House Passage of Bipartisan Tax Bill

⇒ Please urge your Senators to protect and expand funding for child care and early learning programs. (Coalition on Human Needs)

We want to build momentum heading into the Senate (especially since we think it might not get picked up immediately). MomsRising has created a new petition page and a new call-in page to the Senate. People can also text CTC to (888) 418-5699 to connect to MomsRising's hotline to the Senate for free. In addition, here is a resource guide and social media toolkit put together bythe Coalition on Human Needs--this will continue to be updated with Senate-focused materials.

We know how to end child poverty. That is why we are fighting for this expansion right now, and why we will keep fighting to further improve the CTC.   

Supplemental Federal Child Care Funding Update:

As the timeline for passing the national security supplemental request continues to draw out, we are now focused on ensuring that any domestic supplemental that is considered includes $16 billion for child care and early learning.

⇒ Please urge your Members of Congress to support the $16 billion proposal supported by President Biden and many congressional Democrats. 

From the Food Research and Action Center (FRAC): 

This week, appropriators divvied up the $1.7 trillion top-line funding for all government programs. The so-called 302(b) numbers are funding levels allocated to each of the 12 appropriation subcommittees. This begins the intensive work crafting and negotiating the subcommittee bills. Funding for the USDA (including the Special Supplemental Nutrition Program for Women, Infants, and Children — WIC) runs out on March 1. Advocates continue to press for an additional $1 billion to fully fund WIC to avoid 2 million parents and young children being turned away from WIC by September (Center on Budget and Policy Priorities). 

Take action: With negotiations intensifying and a looming March 1 deadline, advocates continue to call on Congress to fully fund WIC. Actions include: utilizing FRAC’s Action Network to send a message directly to Members of Congress; sharing state impact data and WIC’s proven positive outcomes from the National WIC Association and House Education and the Workforce Democrats; texting “FundWIC” to 888-418-5699; using the #FundWIC social media toolkit and FRAC’s and Moms Rising’s Letters to the Editor. 

Report - Child Care Industry Struggling in Pandemic’s Aftermath

Report on the Child Care Industry in the Pandemic’s Aftermath

In the wake of the pandemic, a significant drop in paid child care usage is reshaping the industry. A new report by the Committee for Economic Development finds that despite an overall economic recovery, in 2022 child care services remained almost 10% below pre-pandemic levels. The report suggests that traditional economic and demographic factors cannot fully account for this decline, pointing to remote work, shifting parental preferences, and a reduced supply of child care as potential causes. Report - Leveraging CACFP for Farm to Early Care and Education: Growing Wins Across Early Childhood and Food System Sector

On January 31, with support from the W.K. Kellogg Foundation, Food Research & Action Center (FRAC) released its report: Leveraging CACFP for Farm to Early Care and Education: Growing Wins Across Early Childhood and Food System Sectors, which outlines a pivotal cross-sector approach to improving children’s equitable access to fresh, nutritious foods to reduce hunger. The report provides recommendations and policy changes that support child care providers to access the federal Child and Adult Care Food Program (CACFP) and utilize it for eligible Farm to Early Care and Education (Farm to ECE) activities. 

From the T.E.A.C.H. Early Childhood® National Center:

To continue our longstanding efforts in addressing higher education barriers for the Early Childhood Education workforce, the T.E.A.C.H. Early Childhood® National Center has published, A Roadmap to Student Success for the Early Childhood Education Workforce. The document explores barriers and strategies to address higher education faculty development, increase faculty and higher education institution capacity toward building a more robust and responsive ECE higher education system to support early childhood education workforce students’ success; and creating a career pathway to support early childhood classroom educators whose goal is to move beyond the classroom into faculty and other leadership roles in the field.

Factsheets - How Two Communities are Using ARPA Funds for Young Kids

Our new fact sheets highlight how two communities, Austin, TX, and Tulsa, OK, have used their American Rescue Plan Local Fiscal Recovery Funds to invest in child care, pre-K, foster care, and more.

Field Highlights

One State Rolled Out a Promising Child Care Model. Now Others Are Replicating It.

Last month, business leaders and child care advocates from a handful of states convened on Zoom. Representing Michigan, Kentucky, North Carolina and Virginia, they had come together to discuss a new child care model, called “Tri-Share,” that has gained traction across the country, including in their respective regions.

The cost-sharing model, in which the state government, the employer and the employee each pay for one-third of the cost of child care, first launched in 2021 in Michigan, where it is furthest along. But it has become so popular that other states, including New York, North Carolina and Kentucky, have already secured funding for their own adaptations of the program.

Parents say they could spend more than $36K on child care this year

Parents are depleting their savings accounts to cover child care, a new report released by Care.com shows.

They are working multiple jobs, going into debt and ultimately leaving the workforce because even in a double-income home, the rising costs are too hard to manage, the report reveals.

Care.com, the largest online marketplace connecting families to child care, surveyed 2,000 households on what they are on track to spend this year. In a report of findings published Jan. 17, 49% said they plan to spend about $18,000 on care in 2024, while 23% of respondents said they will spend more than $36,000.

Overview of Fiscal Year (FY) 2025-2027 Child Care and Development Fund (CCDF) Plan Preprint for States and Territories

This Office of Child Care (OCC) webinar provides an overview of the FY 2025-2027 CCDF Plan Preprint for States and Territories, which was released for a 30-day public comment period on January 22, 2024.

Presenters will describe OCC’s approach to refining the Plan Preprint and how the current version reflects the needs expressed by grantees and the public, plus other key child care policy priorities. The webinar is intended for CCDF Lead Agency representatives as well as other state and national partners.

The Plan Preprint requires Lead Agencies to describe how they effectively administer the CCDF program to meet the needs of children and families in alignment with CCDF requirements. OCC has refined and restructured the FY 2025-2027 CCDF Plan Preprint to do the following:

• Reduce the burden on Lead Agencies by asking fewer and more direct questions; simplifying question structure; and aligning purpose and information collection across the Plan, monitoring, and other reporting requirements 
• Prioritize and highlight key child care policy priorities
• Provide a mechanism for States and Territories to communicate their implementation action plans to address areas of non-compliances 

Public comments on the Plan Preprint are due on February 21, 2024.

CDMIS Webinar Announcement: CDD-801A Updates & Introduction to Assembly Bill (AB) 22

Attention: Program Directors, Executive Directors, and Active CDMIS Users

The California Department of Education (CDE) and California Department of Social Services (CDSS) Child Development Management Information System (CDMIS) Support Team will host a webinar on Tuesday, February 13, 2024, from 10:00 a.m. to 11:30 a.m. This session aims to provide valuable guidance on essential updates pertaining to the CDD-801A report, which will be in effect starting from the January 2024 reporting period.

In addition to the updates on the CDD-801A report, we will be providing a brief introduction to the legislation regarding Assembly Bill (AB) 22 and its requirements. A key mandate of the AB 22 is that it requires the CDE, by July 1, 2024, to collect student, teacher, and classroom data for each pupil enrolled in a California State Preschool Program (CSPP) operated by a local education agency (LEA), including all applicable data elements that are collected for pupils in transitional kindergarten, as provided. To meet this mandate, the CDE is developing the California Preschool Data Collection (CAPSDAC) system, which is expected to be launched on July 1, 2024.

This upcoming webinar aims to comprehensively revisit the content discussed in the January 9, 2024, webinar, providing in-depth insights into each update. In this session each section will be followed by detailed explanations of frequently asked questions from the previous webinar, to provide a more thorough understanding of each topic.

RELEASED February 2, 2024: Child Development Management Information System (CDMIS) Update #32: New Reason Codes in “Reason for Receiving Child Care Services” Field

Attention: Program Directors, Executive Directors, Active CDMIS Users, and Software Vendors

On February 1, 2024, two new reason codes will be added to the Reason for Receiving Child Care Services information field. The Reason for Receiving Child Care Services information field indicates the primary reason that subsidized child care services through an agency’s contract with the California Department of Social Services (CDSS) are needed by the family. This is the primary reason used to determine “need” for services. Two new reason codes have been added and will be available for use starting on February 1, 2024, for the January 2024 reporting period.

RELEASED February 1, 2024: CCB 24-02 CHILD CARE PROVIDERS UNITED – CALIFORNIA (CCPU) ACCESS TO PRESERVICE MEETINGS AND ORIENTATIONS

The California Department of Social Services (CDSS) Child Care and Development Division (CCDD) has recently posted the following document on its Internet website: CCB 24-02 CHILD CARE PROVIDERS UNITED – CALIFORNIA (CCPU) ACCESS TO PRESERVICE MEETINGS AND ORIENTATIONS.

The purpose of this Child Care Bulletin (CCB) is to provide County Welfare Departments (CWDs) and contractors with guidance pertaining to newly enacted requirements surrounding Child Care Providers United – California (CCPU) access to preservice meetings and orientations, pursuant to SB 140 (Chapter 193, Statutes of 2023), signed by the Governor on September 13, 2023, and the Agreement between the State of California and the Child Care Providers United (CCPU) union, ratified by CCPU on July 31, 2023.

RELEASED February 1, 2024: Release of the Draft Version of the Child Care and Development Fund (CCDF) 2025-27 State Plan

Every three years, states and territories receiving Child Care and Development Fund (CCDF) allocations must prepare and submit to Administration for Children and Families (ACF) a CCDF State Plan detailing how the State will allocate and expend these funds. The California Department of Social Services (CDSS) has released a draft version of the 2025-27 CCDF State Plan on the CDSS’ CCDF State Plan webpage for public comment.

In Section 4 on Equal Access, there are several questions related to cost analysis and rate setting based on the use of CDSS’s pre-approved alternative methodology for estimating the costs of child care. In the final State Plan, the responses in this section will be updated once additional work on the alternative methodology is completed. An updated timeline for the work related to the alternative methodology will be posted on CCDD’s Rate Reform and Quality Webpage early next week.

Additionally, please note that on January 22, 2024, in the Federal Registry announcement, ACF proposed changes to the state plan preprint, which establishes the questions and format of states’ CCDF plans. These changes are not yet incorporated in California’s draft State Plan due to the timing of the release of the Federal Registry announcement and that the proposed changes from the federal government are not final at this time. Our listening sessions to date have captured information to support responses to existing pre-print format. If ACF approves of the preprint changes, CDSS will transfer information to the new version, which will be submitted to ACF no later than July 1, 2024. Both the Federal Register notice and the CCDF Plan Preprint are posted on OCC’s website.

Individuals can submit written comments regarding CDSS’s posted draft plan during the 30-day public comment period beginning February 1, 2024, through March 1, 2024, via the dedicated email box [email protected].

RELEASED January 23, 2024 **Revised** CDMIS Update #31: Transition to Reporting Enrollment in the CDD-801A Report

Attention: Program Directors, Executive Directors, Active CDMIS Users, and Software Vendors

Commencing with the December 2023 CDD-801A Report, all California State Preschool Program (CSPP) contractors and California Department of Social Services (CDSS) contractors will report all children enrolled for at least one day during the reporting month in their CDD-801A Report. Children should be added to the CDD-801A report during the month associated with their "First Date of Subsidized Service" as indicated on the California Department of Education (CDE) Form 9600 or CDSS CCD 26 Form.

The CDE is currently working on rescinding Management Bulletins (MB) 07-02 and 09-12, which provide guidance for contractors to report all families and children who received subsidized services during the month; this guidance will be revised to instruct contractors to instead report all families and children who were enrolled for subsidized services during the report month. This updated MB is forthcoming, and the contents of this update serve as interim guidance until it is published.

Enrollment-based reporting will be tied to the per-child allocation amount your agency receives in the Cost of Care Plus Rate quarterly advances and true-ups. To ensure your agency receives the correct Cost of Care Plus Rate payment, please review your CDD-801A Reports from December 2023 and thereafter to ensure all children enrolled for at least one day during the month are included in that month’s report. For example, if a child enrolled in your program with a “First Date of Subsidized Service Date” of December 19, 2023, but did not attend your program in the month, they must be reported in your December 2023 CDD-801A. As another example, if a child is disenrolled from your program on November 19, 2023, and was not enrolled for any part of December, they should be removed from your December 2023 CDD-801A.

CDSS Child Care and Development Transition January 2024 Quarterly Report

The transition of child care and development programs from the California Department of Education (CDE) to the California Department of Social Services (CDSS) supports the State’s approach to strengthening our child care and development system to be more comprehensive, high-quality, and affordable.

The January 2024 Child Care Transition Quarterly Report outlines crucial milestones achieved from September to December 2023. It covers a historic second agreement between the State of California and the Child Care Providers United – California (CCPU), and a collaborative effort with WestEd. Additionally, a visual comparison in the report illustrates the rise in annual caseloads for CDSS’ subsidized child care and development programs from October 2022.

Our Monday Morning Update supports our Early Learning & Child Care field with timely information about what is going on in California and nationally; as well as dates to be aware and upcoming events. 

Our weekly Monday morning distribution is to nearly 10,000 federal and state local agencies, resource and referrals, contractors, legislators and their staffs', centers, parents, providers, state departments and advocates.
