Recognizing that Maryland appellate courts have not previously issued a published opinion as to either whether a closing protection letter constitutes a policy of title insurance or when claims against a closing protection letter accrues for statute of limitations purposes, the Court of Special Appeals of Maryland has issued a decision clarifying these, and other, areas of the law.

South Korean investment bank Mirae Asset Daewoo won a significant U.S. court case against Anbang Insurance Group after Mirae reversed its plans to buy 15 U.S. hotels for $5.8 billion at the start of the pandemic.

The urge was strong to call this “No Exit,” but remembrances of Jean Paul Sartre’s play of the same name about a hellish afterlife quickly squelched that idea. Instead, the chosen title should better reflect the realm of real property problems that can plague us in the current plane of life: parcels that do not seem to have access.

A New Jersey federal district court recently ruled that there was no coverage under a title agent's errors and omissions policy for losses resulting from an email phishing scam. In Authentic Title Services, Inc. v. Greenwich Insurance Company, the title agent received emails purporting to be from a mortgage letter, directing the agent to transfer over $480,000 to a specified bank account and to confirm the transfer by email only.
