Council Adopts and Celebrates New Regulations for Short-Term Rentals

At its October 13, 2022 meeting, the Paradise Valley Town Council voted to adopt the latest rules and regulations to protect the neighborhoods in PV from unruly, disruptive, and potentially criminal behavior that occurs at some AirBnBs. This approval is a ‘watershed’ moment for local control since the centerpiece of the new STR ordinance is the ability for PV and all local governments to be able to issue, deny, and/or suspend Short Term Rentals (STRs) for up to a year, under limited circumstances. 


Mayor Jerry Bien-Willner reminded the Council and public that we have gone through threats of lawsuits, an Attorney General investigation, and amendments to restrictive state laws and have won on all accounts, thanks to the collaboration of the Town’s legal team at Gust Rosenfeld, town staff, Mayors from other cities, the Arizona League of Cities and Towns, Highground lobbysts, and the full Town Council. "The real meat of this issue with this action tonight is that we are at the precipice for the first time enabling local control we finally gained from our work with the State legislature" Mayor Bien-Willner shared.


The Mayor went on to thank everyone for their individual and collaborative efforts so we can now suspend a license for up to a year for 1 or 3 verified violations, depending on severity of the violation and have gained the ability for immediate judicial review for the attempted or completed felony act that results in serious injury or death. Susan Edwards said to the full Council “Thank you, thank you, thank you! You are the model for the State. You have done a spectacular job.” Another speaker concurred with “What you have done tonight with this ordinance will be built upon by other cities and towns throughout the State.”


Tim Dickman also spoke to say he has been working on this effort for three years and spoke to the discussion about whether there should be notification by the STRs to the direct neighbors of an STR. He knows of neighbors that are threatened by the STR next door and although he initially thought it was a good idea to notice the adjacent neighbors, he understood fully the risk or fear it may place on neighbors to potentially be in direct contact with an adversarial STR owner.


After public comment, a motion was made by Council Member Pace, seconded by Council Member Andeen, to amend Ordinance 2022-06 to require all STR owners to notify all contiguous neighbors of a STR. The amendment failed 2-5. Council Member Dembow, and seconded by Council Member Moore, moved to adopt Ordinance 2022-06. The motion passed unanimously.


The Town anticipates that when these new enforcement tools to permit and suspend a STR license become effective in mid-November, the Town will concurrently make STR owner contact and other information available to the public. We trust these new technological and enforcement tools will make a significant difference in the behavior of owners who repeatedly bring bad actors into our neighborhoods.

The Town Council also took the following actions at last night’s meeting.


  • Proclaimed October as Domestic Violence Awareness Month
  • Awarded a contract to the Humane Animal Rescue and Trapping Team to provide animal rescue services
  • Adopted Ordinance 2022-06 amending Article 10-14 of the Town Code by adding a requirement for short-term rental owners/operators to obtain a permit to operate and associated provisions to align the Town Code with state law. The Council did not adopt the provision requiring rental property owners to deliver a notice to adjoining neighbors alerting them that the property will be used as a short-term rental.
  • Approved a statement of direction to guide the Planning Commission’s review of the Andaz Resort Intermediate Special Use Permit Amendment
  • Adopted Resolution 2022-22 amending the Council Rules and Procedures regarding the number of votes required to add an item to a future council meeting agenda.

The Maricopa County Elections Department mailed early ballots for the November General Election on October 12 and voters may return their voted ballot by mail or drop off their ballot in the secured ballot box in the Town Hall lobby. The ballots are collected once daily and transported by elections officials to the tabulation center. You may track your ballot by going to BeBallotReady.Vote.


Starting October 28th, voters may vote in-person in the Town Hall Community Room. The early ballot Vote Center will be open Monday through Friday, 8:00 AM to 4:00 PM. On Election Day, voters may vote in the Community Room or at Ascension Lutheran Church located at 7100 N. Mockingbird Ln. The polls will be open from 6:00 AM to 7:00 PM.

On October 13, 2022, Town Council was pleased to present a Domestic Violence Awareness Month proclamation to Chrysalis President & CEO Patricia Klahr for over 40 trailblazing years of supporting and offering resources to those who have experienced domestic violence. In addressing the many who reach out to them through their website Chrysalis - No Abuse Emergency Shelter and in person at the shelter, Ms. Klahr shared "We are here to serve, guide and help everyone who enters our site or doors. If you are here, we are here."

Hillside Committee Meets to Discuss Formal Reviews  

The Hillside Building Committee reviews all development plans for properties designated “Hillside” at the Concept Stage and the Formal stage.



The purpose of the Concept Review is to discuss, review, and give suggestions and guidance to the Applicant regarding the proposed development including location of building pad and accessory uses; relation to Significant Natural Features; preservation of existing vegetation; Grading concepts and their adaptation to the natural hillside topography.


The purpose of the Formal Review is to review all materials and plans for compliance with the goals, purposes, and specific ordinance criteria.


On October 12, 2022, The Hillside Building Committee agenda included two Concept Reviews and 2 Formal Reviews.


Concept Review for a new 10,500 Square foot single-family residence on 2.195 acres at 4474 E Valley Vista Lane.

PV Police Update

PVPD Chief Wingert Retiring: New Police Chief Named 


After 31-years in law enforcement, and the last seven as chief of the Paradise Valley Police Department (PVPD), Chief Wingert is resigning to pursue a national policy position. Commander Freeman Carney of the PVPD has been promoted by the Town Manager to lead the department. The changes are effective December 10, 2022.

 

“I’m thrilled that Commander Carney has accepted the role, and the opportunity to continue building on the foundation set by Chief Wingert,” said Town Manager Jill Keimach, who is responsible for making the Town’s director-level hires. “The Town is incredibly proud of the entire force, and the work they do every day to make Paradise Valley an amazing community.”

 

During his tenure, Chief Wingert, along with his officers and Command staff, developed an accredited agency that provides exceptional customer service, is highly trained, and can respond to any threat or incident inside and outside the Town’s borders, protecting residents and visitors.

 

“I have tremendous respect and appreciation for Chief Wingert and the outstanding work he has done leading the Department through some extremely challenging times,” Mayor Jerry Bien-Willner said. “I look forward to working with Commander Carney as he takes over this critical role for our community. He is a proven and well-respected leader within our Police Department.”

Commander Carney has been with the PVPD for more than 11 years and was previously with the City of Avondale Police Department.

 

“I'm excited and humbled by the opportunity to be following Chief Wingert as Chief of Police. Chief Pete has set a very high bar and has been a strong leader for the force and the community,” Commander Carney said. “While it will be tough to fill his shoes, we have a tremendous team, staff and Town Council supporting our work.”

 

“Our Town has been well-served by Chief Wingert, and I, along with the entire Town Council wish him well on his future endeavors,” said Vice Mayor Anna Thomasson. “Commander Carney will be a great successor to Chief Wingert, and I have every confidence he will continue serving with distinction.”

Breast Cancer Awareness


PV Officers will be wearing pink patches on their uniforms for Breast Cancer Awareness Month during October and November to raise awareness of all forms of cancer impacting the community. Pink patches are available to the general public for $5 each as a fundraiser with proceeds going to the Phoenix Campus of the Breast Cancer Research at UofA at the end of the campaign.
