Faculty Members' Rights and Responsibilities Under Title IX

This presentation will explore the ways in which Title IX affects college and university faculty, as a source of employment rights as well as responsibilities to prevent and address sex discrimination students experience in the classroom and in other facets of college life. Equal pay, tenure, STEM, sexual assault prevention, and the recent federal litigation in Emeldi v. University of Oregon (finding actionable a grad student's claim of retaliation for complaining about sex discrimination in her department) and other related aspects of Title IX will all be addressed.   

Discussing Compliance Issues with University Governing Boards: Lessons Learned from the Penn State Experience

Within institutions of higher education, the administration is responsible for many day-to-day compliance functions, including compliance with Title IX. Beyond the day-to-day activities, however, the governing board of an institution of higher education is responsible for exercising oversight and ensuring that the institution is meeting its legal mandates. Governing boards also approve the institution’s budget and have the ability to direct resources to where they are most needed, but that only occurs when the governing board is well informed about its obligations and areas of risk. Using Penn State’s experience and the Freeh Group’s recommendations, this session will describe the role and functions of governing board, examine the governing board’s duties and obligations, and provide strategies for addressing compliance gaps.

The National Association of Scholars (NAS), collected data from a random sample of 52 colleges and universities across the country to study the gender makeup among Title IX Coordinators. Gender Inequity Among the Gender Equity Enforcers

On June 12th, the National Association of Scholars (NAS) released a research study in response to the question, “What is the racial/gender makeup of the campus student-conduct offices regulating [campus sexual harassment]?” This question stems from the recent University of Montana Resolution agreement from the Office of Civil Rights. If the rules from the resolution agreement are truly to be a “blueprint” for colleges and universities, then who are the persons we entrust with such great power in procedural protection and where are they located on your campus? Are these persons representative of your student body and employee population?
