U.S. Supreme Court Blocks OSHA’s Vaccine Mandate for Private Employers, but Allows it for Healthcare Workers
Many employers across the nation can now breathe a sigh of relief. In a 5-4 decision, the U.S. Supreme Court today blocked OSHA’s COVID-19 vaccine mandate for private employers with 100 or more employees. The Court stated OSHA did not have the authority to impose such a mandate. The mandate would have required covered employers to ensure their workers were vaccinated or tested every week for COVID-19. However, the Court did allow the mandate to proceed with healthcare workers whose facilities participate in Medicare and Medicaid.
