U.S. and Canadian Immigration and Nationality Law (Bimonthly) Newsletter and Updates.

Dear Readers,

Each year, many foreign nationals vie for the limited H-1B visas to work and live in the United States. As not everyone can secure an H-1B, it's crucial to explore alternative work visa options.

Some alternatives include cap-exempt H-1B visas for those employed by higher education or research organizations, and professional specialty worker visas like H-1B1, TN, and E-3, designated for nationals of specific countries. Treaty Trader/Investor visas, E-1 and E-2, can be considered by those engaged in substantial international trade or investment.

For foreign graduates, post-completion OPT or STEM OPT extensions may provide additional opportunities to secure an H-1B visa. The L-1 visa is an option for employees of companies with an offshore presence, while the O-1 visa is available to those with extraordinary abilities or achievements.

Before giving up on an American Dream, NPZ immigration and Nationality Lawyers can work with you and your employer to explore immigrant, and nonimmigrant work visa alternatives that may be beneficial under appropriate circumstances.
