The Class Action Lawsuit was filed on behalf of all boaters/slip holders. The intention is not only to get a roll-back of slip rates but to force the Defendants, the Dana Point Harbor Partners (DPHP), to refund to all slip holders that portion of the slip fees paid in excess of the true market rate. In the last month, the DPHP has compelled the three boaters/Plaintiffs, as well as the President of the Dana Point Boaters Association (DPBA) and the head of Save our Slips (SOS), to attend deposition examinations that lasted up to 8 hours each of grueling, aggressive questioning. These individuals volunteered to take on this role, again to benefit all boaters, and without compensation.
DPHP’s principals are now being compelled to appear for depositions and answer as to their actions. The first such deposition is scheduled for later this month. Further, a new Judge was appointed to hear this matter, and a hearing on the status is set for later this month, at which time we hope new dates and deadlines will be set to move this case along toward final resolution. These activities will be expensive and are necessary for the Class Action to proceed.
Raising funds may appear fairly obvious when reduced to the understanding that money is needed for items, services, and programs. However, fundraising is important for a variety of other reasons as well. The Class Action lawsuit filed on behalf of Dana Point slip holders continues to intensify and move forward. Fundraising receipts in support of the Class Action must keep pace with the rising costs.
