At the Motion for Summary Judgement hearing on June 1st, the Judge did not make a final ruling, but asked for additional Briefs.
Primarily, he initially intended to rule against the Plaintiffs (boaters) and find that slip holders were not 3rd Party Beneficiaries of the lease agreement and so had no standing to continue the lawsuit. (We thought the previous judge settled that issue when she found slip holders were 3rd Party Beneficiaries. However, this Judge didn't agree it was settled.) After arguments, the Judge wants each party to file a new Brief just on that issue and will take it under submission and send out a ruling.
The Brief is due June 15. We will keep you advised.
