Members of the DPBA board recently met with Supervisor Foley and Alyssa Napuri, Deputy Chief of Staff, for an update on the harbor revitalization.
Highlights from our meeting were:

The Supervisor and Staff have assisted DPHP with getting permits for the parking structure, which is scheduled to break ground in January 2024. DPHP has obtained financing for the parking structure, but it will require an estoppel certificate and agreement, which will need to be approved by the Board of Supervisors and executed by the Chief Real Estate Officer. DPBA will review the estoppel agreement when it appears on the agenda and comment, if necessary, regarding the language. DPBA has requested a copy of the parking structure plans and the construction timeline and will post them on our website. They will also be posted on the 5th District website at https://bos5.ocgov.com/dana-point-harbor-updates.

A decision has been made not to use the Third-Party Owner’s Representative for oversight of the revitalization project. The Owner’s Representative, Butier Engineering, was approved by the Board of Supervisors on November 5, 2019, and a contract was signed that day. It appears they have not been used for oversight to date. The new plan is to appoint a full-time staff person in the OC Real Estate office to manage oversight.

A consulting firm, Keyser Marston Associates, who is on retainer with the County, has been brought in on this project for financial analysis and oversight.

Supervisor Foley is working with DPHP on the permits from the CA Coastal Commission for the hotels.

Regarding milestones outlined in the Master Lease, Supervisor Foley is confident DPHP will meet each milestone on time.

Supervisor Foley has been advised the slip layout has not changed from the plan approved by the CA Coastal Commission. Any discrepancies should be reported to her. DPBA will send an updated list. She also requested technical questions regarding ADA compliance and fire suppression be sent to her for review, which we will do.

At the request of Supervisor Foley, Orange County has applied for a grant from the CA Division of Boating and Waterways for the construction of new slips at the Sailing and Events Center.
Supervisor Foley also provided answers to boaters’ questions submitted to her after our last two DPBA general meetings. Click here to access the answers. The answer to question 19 is the one we find most puzzling.
19. There seems to be some oversized boats in slips in Phase 1 and Phase 2, also some severely undersized. Are these boats in permanent slips or are these transition slips for these boats?
Phases 1 and 2 of the Marina Improvement Project are now complete. These slips have been allocated to permanent slip tenants who personally chose their new slip locations. It’s important to note that while the DPHP’s Slip License Agreement (SLA) has guidelines regarding berth and vessel sizes, existing tenants retain the flexibility to rent slips for both oversized and undersized boats, similar to their arrangements under the previous marina management company. This is permitted if their choices do not compromise safety, navigation, or the integrity of marina infrastructure. For new tenants, it is essential to emphasize that they will be required to comply with the current policy, including the maximum allowable slip length.
