USCIS Resumes Premium Processing for All H-1B Petitions

The U.S. Citizenship & Immigration Service (USCIS) announced on 3/11/2019 that it would resume the premium processing service for ALL H-1B petitions starting today - 3/12/2019.

This means that any pending H-1B petitions may be upgraded to premium processing.  Individuals with pending H-1B petitions who want to upgrade them to premium processing should mail a check to my office address as follows:

Payable to:          Law Office of Leila Freijy PLLC
Amount:              $1560

This covers the $1410 Premium Processing fee, $100 in legal fees and two UPS shipments (of $25 each).

This also appears to apply to H-1B cap cases.  Individuals for whom we are about to file H-1B cap cases who want their petitions filed under premium should mail a check to my office address as follows:

Payable to:          Law Office of Leila Freijy PLLC
Amount:              $1410

In either situation above, if the check is not drawn on the bank account of the employee whose case we are to file/convert to premium, they will need to put their name in the memo field of the check.  Cashiers checks are also acceptable.

Keep in mind that the likely knee-jerk reaction of the USCIS will be to issue RFEs on most/all of the petitions being converted to, or filed under, premium.  We even saw this in cases that had already received RFEs last year and were recently converted to premium when USCIS resumed premium processing for petitions filed on or before 12/21/2018.  In almost all of those cases, the USCIS issued a second RFE.
