Understanding how the Berry Amendment Applies During COVID-19

Across America, we are witnessing our first responders and health care providers struggling to secure medical-grade PPE (Personal Protective Equipment). In response to this need, many of our businesses are re-purposing and retooling their factories to produce medical equipment, supplies, and PPE to battle this virus. Many of our federal agencies are leading the effort in working together to supply the needs across the country. A quick search for PPE on beta.sam.gov for contract opportunities will garner many different agencies needing various items. How does the Berry Amendment apply to these opportunities?
 
What is the Berry Amendment?
 
In 1941, Congress passed the DoD Appropriations Act to protect the domestic industrial base during time of war, it was later renamed and referred to as the Berry Amendment (10 U.S.C. 2533a). This meant that restrictions were placed that required the Department of Defense to give preference in procurement to domestically produced, manufactured, or home-grown products. Golden Tech Systems Inc.

GoldenTech Systems Inc. was founded in 2007 by its current President, Pushpinder Garcha. They are a systems integrator firm that delivers digital capabilities to the warfighter. Their solutions span across the cloud, cyber, and DevSecOps domains. As an SBA certified 8(a) firm, they won their first Prime contract to provide systems administration and cybersecurity services to Hill AFB, in September 2019. Their client is the Air Force Nuclear Weapons Center, and they are supporting the Air Force Material  Command. This was a huge milestone for their firm, as they had just entered the DoD  contracting world, after spending nearly 11 years in the commercial market.

Golden Tech is located in Charlotte, North Carolina, and became a client of the Procurement Technical Assistance Center (PTAC) in 2017. PTAC has assisted Golden Tech with navigating the complexities of government contracting, assisting with RFP and PWS requirements, and pricing strategies.
 
Golden Tech Systems Inc. is a growing small business with a prodigious amount of experience, knowledge, and efficacy. They are creating pathways to be impactful players in their industry.
