Unfair Labor Practice

Dear TT Faculty,

It has come to our attention that the administration has committed the unfair labor practice (ULP) known as direct dealing.

On Friday, October 2nd, the upper administration apparently shared with all chairs, directors, and deans, a five-page document responding to a statement for the record that KSUFA’s TT bargaining unit had made at the table on September 25. This five-page response document had been shared with me in a one-on-one meeting by Associate Provost of Faculty Affairs Kevin West on September 30 in a last-ditch effort to prevent KSUFA from declaring impasse and circulating the No Confidence Petition. The five-page response document has now been shared with at least some faculty by administrators who received it in direct violation of the State laws regarding direct dealing.

The five-page response document suggested that the administration was prepared to put on the table a salary package similar to the one that KSUFA proposed on August 12, 2026, but only on the condition that KSUFA agreed to accept the administration’s proposals that would radically undermine our collective bargaining rights and Faculty Senate’s historical role in the governance process.

Please understand that no actual salary proposal along those lines has been put on the table by the administration.

We are pleased that the administration has signaled that they can indeed afford the salary proposal that KSUFA made in August and we look forward to receiving an actual counter-proposal on salary and medical benefits from the administration in the not-too-distant future. However, and as we have explained to the administration, our bargaining rights and Senate’s role in the governance process are not for sale!

In the meantime, we will consult with our attorney about whether it makes sense to file a formal Unfair Labor Practice charge against the administration.

In solidarity,

Deb
