BREAKING IMMIGRATION NEWS

2/1/2024 Issue

MORE $

After many years, (the Immigration Services says after 7 years) the government announced an increase in filing fees for all applications and petitions at the U.S. Immigration and Naturalization Services (USCIS). WARNING: Those increases are only at USCIS inside the U.S. Separate fee increases may be announced for Immigration Courts, National Visa Center (NVC), U.S. Consulates overseas, U.S. Department of Labor, etc.

No doubt, doing an immigration case will become an expensive project, especially for a big family.

HOW MUCH MORE $

There are many types of applications and petitions that are filed by many applicants and petitioners to USCIS every year. Some applications and petitions are even submitted in one package. It is useless to detail here all those applications and petitions in this short message. The following information is about some of the most frequently used applications and petitions. The Immigration Service relates to each one by the FORM NUMBERS, and so will we:

Form I-129 (H-1B) – increase from $460 to $780 (an increase of 70%).

H-1B Registration for the lottery, increase from $10 to $215 (2,050%). This is one increase that I agree with wholeheartedly, because it is designed to minimize fraudulent registrations for this rare type of working visa.

Form I-130 (Petition for Alien Relative) – increase from $535 to $625 (17%), if filing online. For the same petition but “paper filing”, the increase is by $50 more to $675 (26%).

Form I-140 (Petition for Alien Worker), increase from $700 to $715 (2%).

Form I-485 (Application for Adjustment of Status), increase from $1,140 to $1,440 (26%).

Form I-485 (Application for Adjustment of Status with Biometrics), increase from $1,225 to $1,440 (12%).

Form I-539 (Application to Extend/Change Non-Immigrant Status), if online filing – increase from $370 to $420 (14%), but “paper filing” for same application, the increase will be from $370 to $470 (27%).

Form I-601 (Application for Waiver), increase from $930 to $1,050 (13%).

Form I-601A (Provisional Unlawful Presence Waiver), increase from $630 to $795 (26%).

Form I-694 (Notice of Appeal from a Decision), increase from $890 to $1125 (26%).

Form I-751 (Petition to Remove Condition), increase from $595 to $750 (26%).

Form I-765 (Application for Employment Authorization), if online filing, increase from $410 to $470 (15%), but if “paper filing”, increase to $520 (27%).

Form N-400 with Biometrics(Application for Naturalization), if filed online increase from $640 to $710 (11%), but if “paper filing”, increase from $725 to $760 (5%).

USCIS Immigrant Fee (to be paid byapplicants for immigrant visas who had their interviews at American Consulates overseas), increase from $220 to $235 (7%).

WHEN MORE $

The new fees will become effective on April 1, 2024. In other words, the government is giving us advance notice of approximately two months to RUSH and file our applications and petitions before the new, higher fees catch us.

BETTER SERVICE FOR MORE $?

There is no doubt that after 7 years, the cost of EVERYTHING WENT UP. It is justified that the cost of immigration services to the people who need such services should also go up. But the question remains: with the higher costs – would the services improve? Will processing of applications and petitions be done in a more reasonable time? This remains to be seen.
