WHAT NOW?

Former Vice President Joe Biden, is now President Elect Biden. He will become President Biden on January 20, 2021. A little more than two (2) months from now. He still cannot govern the U.S.
WHAT RIGHT NOW: as President Elect, Mr. Biden cannot issue orders, make or change laws. For these powers, he needs to wait until January 20, 2021, when he is sworn in as the 46th President of the U.S. But, he can make preparations and publish his plans. What can we expect from him in the field of IMMIGRATION?
LEGALIZATION: or a new Amnesty, requires legislation, the passage of a new law by Congress. At present this is doubtful, because it is still not known whether the Democratic Party will have a majority in the U.S. Senate. However, the President could try for a “semi” legislation like the DAPA Program (Deferred Action for Parents of U.S. Children), which was attempted by President Obama but was declared illegal by the court. But this will be a long time coming, if at all.

COMPREHENSIVE IMMIGRATION REFORM: Also, requires legislation, a new law, meaning a majority in the Senate or an agreement with the Republican Party. Maybe – but not soon.
 
 DACA: can be revived, fast and easily –by a Presidential Executive Order (E.O.). We expect this would happen soon, in January or February 2021.

TRAVEL BAN: There are, actually, two (2) Travel Bans: First, against immigrants and non-immigrants from certain Moslem countries, and Second – against most immigrants and temporary workers from all countries because of Covid-19 conditions. The second travel ban is supposed to expire on December 31, 2020 (before the inauguration of President Biden). We expect that President Biden will cancelthe anti-Moslem travel ban in January or February 2021. It is unknown what would happen to the second travel ban: Will President Trump extend it again on 12/31/2020? And if he does – will President Biden cancel it on or after January 20, 2021?
PUBLIC CHARGE: The Trump administration made legal immigration very difficult by passing tough requirements for providing “financial responsibility” for new immigrants. More restrictions are in the pipeline. This was done by passing new Regulations. Changes in this area require, again, passing of new Regulations. This will take time.
 
 NEW FEES: The new, higher – much higher – immigration FILING FEES, were passed by Regulation and cannot be cancelled by Executive Order. However, the new fees are blocked by court order. The Biden administration may nullify the new fees by not appealing the present Court Order. We believe that there will be new Filing Fees, but probably not as high as what the Trump administration wants to impose on all applications and petitions.
 
 PROCESSING DELAYS: As part of his desire to cut LEGAL IMMIGRATION, President Trump’s Immigration Service slowed down, delayed and held up the processing of all Application and Petitions. Everything now takes double and triple time of what it used to take. This was not done by legislation or by Executive Order – just by changing the management of the Immigration Service. (Same thing happened with the U.S. Post Office.) The Biden administration could “repair” this problem by simply bringing in new managers. We expect this to happen soon.
