LEGALIZATION: or a new Amnesty, requires legislation, the passage of a new law by Congress. At present this is doubtful, because it is still not known whether the Democratic Party will have a majority in the U.S. Senate. However, the President could try for a “semi” legislation like the DAPA Program (Deferred Action for Parents of U.S. Children), which was attempted by President Obama but was declared illegal by the court. But this will be a long time coming, if at all.
COMPREHENSIVE IMMIGRATION REFORM: Also, requires legislation, a new law, meaning a majority in the Senate or an agreement with the Republican Party. Maybe – but not soon.
DACA: can be revived, fast and easily –by a Presidential Executive Order (E.O.). We expect this would happen soon, in January or February 2021.
TRAVEL BAN: There are, actually, two (2) Travel Bans: First, against immigrants and non-immigrants from certain Moslem countries, and Second – against most immigrants and temporary workers from all countries because of Covid-19 conditions. The second travel ban is supposed to expire on December 31, 2020 (before the inauguration of President Biden). We expect that President Biden will cancelthe anti-Moslem travel ban in January or February 2021. It is unknown what would happen to the second travel ban: Will President Trump extend it again on 12/31/2020? And if he does – will President Biden cancel it on or after January 20, 2021?
