TCAA Capitol Activities
The Texas Legislature completes the 85th Regular Legislative Session on Memorial Day - Monday, May 29. Unless Governor Greg Abbott calls the legislators back for a special session, the Texas Legislature will not convene again until January 8, 2019. The last day for Governor Abbott to veto bills passed during the final 10 days of the session is Sunday, June 18.
The recently completed legislative session was a success for community associations in Texas. Though TCAA was not pushing a legislative agenda this session, the TCAA advocacy team at the Capitol and the TCAA Board's legislative review team worked tirelessly to improve and, as necessary, defeat legislation harmful to associations, communities, and homeowners. In a session where many advocacy groups and stakeholders came away with tough losses, TCAA and its supporters were able to find a path to success.

Last Minute Amendments
The TCAA legislative team remained vigilant right through the final days of session. For example, the text of SB 1620 by Senator Van Taylor, removing certain prohibitions on residents raising backyard chickens, was added as a floor amendment to an omnibus county regulation bill after midnight on Tuesday night. TCAA was watching this legislation closely during the legislative session to ensure no adverse affect on property owners' associations. The underlying bill ultimately was amended nearly 50 times, including the addition of multiple controversial provisions such as transgender bathroom regulations and new limits on local property taxes. These provisions garnered enough opposition that the bill and all of its amendments failed to pass.
Bills of Note
The most notable legislatively approved bill directly affecting community associations is HB 561, relating to the use of certain golf carts or utility vehicles to operate as package delivery vehicles. TCAA was successful in improving this legislation to preserve the ability of homeowner associations to regulate certain usages of these vehicles.
Below is an overview of other high-profile bills that impacted community associations, but failed to pass out of the Legislature: 
  • HB 522, relating to regulation of religious displays
  • SB 1609, the Senate companion to HB 522 relating to regulation of religious displays
  • HB 923, relating to excessive property owners' association fines
  • HB 1572, relating to the removal of trees believed to be a fire risk
  • HB 2320, restricting declarant control of property owners' associations
  • HB 3065, relating to mechanic's, contractor's, or materialman's liens on condominium units
  • HB 3528, relating to the collection of past due assessments by a property owners' association
  • HB 4026, relating to eligibility to serve on the governing body of certain property owners' associations

The final step toward earning the PCAM designation.
The PCAM Case Study is a comprehensive examination of an actual community association, combining classroom discussion with an extensive on-site inspection. You'll explore the community in depth, reviewing its administrative procedures, legal documents and communications; meeting with its manager, board members and key personnel; and learning about the local area. You'll be encouraged to ask questions and openly discuss issues faced by the association.

To register for the PCAM Case Study, you must successfully complete the prerequisite courses ( all 200-level PMDP courses) and receive written confirmation that your PCAM application has been approved within the previous year (other requirements apply).
