Reducing Risk in Land Use Matters: 
Land use is one of the greatest sources of risk for local government. Learn some of the greatest pitfalls and places to avoid risk including: the Land Use Petition Act, vesting, property rights, damages, development agreements, OPMA and PRA, improper purposes, first amendment rights, taking and eminent domain.

Scott M. Missall is a member at Ogden Murphy Wallace PLLC in Seattle, Washington and practices in the fields of land use and development, municipal and governmental law, public law procedures and ethics, and related litigation. He has or is serving as City Attorney for Medina, Yarrow Point, Mill Creek and Bothell.

Mr. Missall received a double B.A. from Western Washington University in Political Science and Philosophy, and obtained his J.D. in 1983 from The Northwestern School of Law of Lewis and Clark College in Portland, Oregon where he was a staff editor on Law Review. Mr. Missall is a member of the American, Washington State and King County Bar Associations, is active in the Washington State Association of Municipal Attorneys, and is a past Chair of the WSBA Administrative Law Section.

He has served as a Director and Chair of the Board of Directors for Evergreen Goodwill of the Pacific Northwest since 1997, and is an inaugural and continuing member of the Advancement Council of the College of Humanities and Social Sciences at Western Washington University.
Emily Miner, Attorney at Law

As an attorney in the firm’s municipal group, Emily proactively assists municipalities in all areas of the law including land use, public works projects and financing, telecommunications, and regulatory compliance. Municipalities face complicated and complex problems, and Emily strategically collaborates with staff, elected officials, and residents to create practical legal solutions for her clients. Whether advising clients regarding the effect of new regulations, negotiating public-private partnerships, or advocating in litigation, Emily leverages her experience and ability to connect with her clients to synthesize information and solve problems.

Emily received her B.S. in Political Science from University of Oregon and her J.D. from Seattle University School of Law. During law school, Emily was a staff editor for the Seattle Journal for Social Justice, and externed with both the City of Bellevue and the City of Seattle’s legal departments. Prior to joining Ogden Murphy Wallace, Emily worked at a local land use law firm advising clients on land use permitting procedures and requirements, and assisting clients with land use appeals. Emily is admitted to practice in Washington, and the U.S. District Court for the Western District of Washington.

Having moved from Alaska to Seattle for law school, you can most likely find Emily outside exploring Washington’s lakes and mountains via skies and kayaks with her Shiba Inu, Kitsune.
