LICENSEES FOR UNITED STATES PATENT 7,531,709

Provectus holds an exclusive license to US Patent 7,531,709 (‘709) with rights to sublicense the technology. We previously announced that an Ex Parte Reexamination was requested by On-Materials, LLC (a former licensee). Upon completion of rigorous review and expert examination, a Reexamination Certificate that affirmed the patentability of the technology captured in the claims of the ‘709 patent was issued on July 16, 2018 ( click here ). The Reexamination Certificate validates the technology described in the ‘709 Patent and avows our continued commitment to defending our intellectual property assets.

Below is an updated list of authorized / licensed companies and their corresponding technologies. If another vendor or relevant product is not listed, it may infringe the ‘709 patent.
NOTES:
  1. Combining a licensed technology with additional non-licensed organic carbon and/or zero-valent metals is excluded from the product license, and buyer is responsible for additional licensee fees.
  2. Combining a licensed technology with nutrients, oxygen scavenger and/or vitamins B2 and/or B12 is excluded from the product license, and buyer is responsible for additional licensee fees.
  3. We strongly recommend a user confirms that any related but unlicensed technology or remedial process does not infringe ‘709.
‘709 Patent Overview
In brief, IET’s technology captured in the ‘709 Patent consists of combining an organic hydrogen donor ( e.g., oil, emulsified oil, lecithin, emulsified lecithin, fibrous organic matter / vegetable matter, sugars, et cetera ) with zero valent metal ( e.g ., ZVI) for remediation of soil, sediment or groundwater. Therefore, any process that removes halogenated organic contaminants from groundwater that employs an organic hydrogen donor plus ZVI (or other zero valent metal) of any shape and size, often referred to as In Situ Chemical Reduction (ISCR), is covered by ‘709. Moreover, IET’s ‘709 patent is not tied into a specific mode of application, but offers examples using higher pressure injections.

Industry Awareness – Legal ‘709 Licensees
Technology end-users and their consultants should be aware of their exposure to potential litigation through their use of unauthorized amendments from unlicensed vendors and/or contractors. It is inherently unfair to formal licensees such as Provectus and our sublicensees identified - who respect the intellectual property rights of others and thus obtained a license for a fee - to be at a cost disadvantage to those who disrespect and misappropriate patented technology.
