Update to Carlsbad Businesses
Regarding COVID-19 Health Orders
With the rapid escalation of COVID-19 case rates across the state and county, several new health orders were announced this week. This email provides details regarding the updated guidance and orders as it may pertain to businesses.

On Thursday, November 19, the State of California issued a new limited stay at home order, which goes into effect on November 21, at 10:00pm.

 “…all gatherings with members of other households and all activities conducted outside the residence, lodging, or temporary accommodation with members of other households cease between 10:00pm PST and 5:00am PST, except for those activities associated with the operation, maintenance, or usage of critical infrastructure or required by law.”

Today, the County of San Diego issued a corresponding health order that aligns with the state’s limited stay at home order. As we understand from the county, this order is not meant to further impact business operations. As an example, restaurants, which were already needing to close for dine-in patrons by 10:00pm, can maintain delivery, take-out and drive-thru operations past 10:00pm. The updated order also references updated guidance on the use of face coverings.

We have also received several inquiries regarding the county’s announcement to issue cease and desist orders to businesses. The county announced on Monday – and reiterated on Thursday – that they will be issuing and enforcing cease and desist orders to businesses operating out of compliance with established industry guidance. Businesses that continue to operate out of compliance may receive fines and/or a closure order. We encourage all businesses to review the current industry guidance and any associated occupancy limitations from being in the purple tier.
