Urban Umbrella Files Patent and Trade Dress Lawsuit Against Spring Scaffolding

Over the past two years, Spring Scaffolding has engaged in the illegal installation of white scaffolding, deliberately copying Urban Umbrella's patented design elements. This unauthorized replication of the Urban Umbrella's distinctive appearance constitutes trade dress infringement under federal and common law. In response, Urban Umbrella has taken strong action by filing a lawsuit against Spring Scaffolding. The lawsuit includes claims of patent infringement and common law unfair competition. The company is seeking a permanent injunction that would require the removal of all unauthorized Spring Scaffolds.

As a company holding 11 patents, including the prestigious U.S. Patent D958,412 granted by the US Patent and Trademark Office in 2022, Urban Umbrella is determined to protect its intellectual property rights. Additionally, the use of white-colored scaffolding with arched supports infringes upon Urban Umbrella's unique trade dress, which has been recognized and acclaimed by the New York City Department of Buildings' urbanSHED Design Competition and is featured in the NYC Building Code.

Urban Umbrella Launches Event Canopy at Tribeca Film Festival

Urban Umbrella's new Event Canopy is now live at the 22nd Annual Tribeca Festival. In partnership with Overland Entertainment, Urban Umbrella designed and installed the centrepiece canopy for the Festival's prestigious red-carpeted entranceway. The festival previously used a tent for the entrance.


This venture into event activations is not Urban Umbrella's first. Last summer, the company made a captivating debut with its Event Activation Canopy at the National Building Museum in Washington, D.C., providing an enchanting backdrop for The Playhouse, an interactive and immersive exhibition. The Event Activation Canopy has also made notable appearances at last year's Art Basel in Miami and Bank of America's annual Bryant Park Winter Village in New York City. Additionally, Urban Umbrella has played an integral role in multiple seasons of New York Fashion Week and has provided its distinguished canopy services to luxury retailers in Manhattan, Boston, and Chicago.

Urban Umbrella Selected for Mixed-Use Development in the Bronx

Urban Umbrella completed its first job in The Bronx at 101 Lincoln Av, a 25-story residential development complex by Brookfield Properties. The project, entitled Lincoln at Bankside, is set to anchor a new residential area in the once-predominantly industrial Mott Haven.

Local Law 11 Filing Fees & Penalties

In an effort to enforce compliance with Local Law 11 subcycles, the city of New York has implemented fees and penalties for buildings that fail to file within the designated timeframes. Owners will now bear the responsibility of a civil penalty of up to $5,000.00 per year immediately following the conclusion of their respective filing window. Additionally, any owner who submits their filing late will be subject to a civil penalty of $1,000.00 per month, starting the day after the assigned filing deadline and concluding on the date of submission of an acceptable initial report. Moreover, failure to address SWARMP (Safe with a Repair and Maintenance Program) conditions prior to the subsequent filing cycle will result in a civil penalty of $2,000.00.

Parking Garage Collapse:

A New Local Law, and What This Means For You

Lower Manhattan was gripped by a terrifying incident on Tuesday, April 18th, when a nearly 100-year-old four-story parking garage on Ann Street in the Financial District suddenly collapsed, resulting in the loss of one life and causing injuries to several others. The garage, plagued by a history of violations and structural concerns, had six open Department of Buildings violations dating back to 2003, half of which were categorized as "hazardous" and required immediate attention. Additionally, the building had been cited for 64 additional violations dating back to 1976.


Urban Umbrella anticipates that the collapse in Manhattan will lead to reforms in building codes and regulations, possibly building upon recently enacted legislation. In 2021, New York City's City Council passed Local Law 126, a significant piece of legislation similar to the well-known Local Law 11. This law mandates regular inspection and maintenance of parking structures citywide. Under the new code, all parking structures must undergo inspection by a registered professional engineer every six years (in contrast to the previous five-year interval specified by Local Law 11), with inspection cycles divided into sub-cycles based on location. Despite the positive steps taken with this nascent legislation, it is clear that tragedy could not be entirely averted. The first inspection cycle commenced on January 1, 2022, and the subcycles are as follows:


  • Subcycle 1A: All parking structures in Manhattan south of 59th Street on the East Side and south of 110th Street on the West Side. Filing period: January 1, 2022, to December 31, 2023.
  • Subcycle 1B: All parking structures in Brooklyn and other areas of Manhattan. Filing period: January 1, 2024, to December 31, 2025.
  • Subcycle 1C: All parking structures in Queens, The Bronx, and Staten Island. Filing period: January 1, 2026, to December 31, 2027.


In line with the requirements set by Local Law 11 for facade inspections, it is highly likely that these parking structure examinations will necessitate the installation of scaffolding. In fact, this past winter, Urban Umbrella installed its first sidewalk shed in connection with Local Law 126 at a parking garage in Midtown Manhattan.
