Use of EasyFund Not Permissible for Alberta Lawyers

Trust Safety has received inquiries about whether lawyers comply with the Rules of the Law Society of Alberta and the Legal Profession Act in using the EasyFund service offered by First Canadian Title. The answer is no.

As per Rule 119.22 (1), a law firm that receives trust money on behalf of a client must deposit the trust money into a pooled trust account of the law firm. Trust funds cannot be sent to a service provider’s account to be held pending payout.

Accordingly, using the EasyFund service is not permissible under the Rules. If you have any further questions, contact the Practice Advisors.
