Our Policy Preparation and Underwriting Guidance sections can serve as checklists. Under Policy Preparation, you will find answers to out of the ordinary situations such as what to do with manufactured homes, transactions involving entities (LLCs, corporations, partnerships, trusts) or how to handle policies with multiple mortgages. The Underwriting Guidance section includes "how-to" guidance for situations involving unique Powers of Attorney or removing the survey and parties in possession Exceptions in Schedule B.

Keys to Avoid Ransomware: Don’t Get Locked Out!

Although ransomware has been around since the late-1980s, its use has greatly increased. It has become a prevalent form of malware that shows no sign of slowing down in its path of destruction. Recent media stories involve ransomware attacks, such as CryptoLocker, CryptoWall, and, perhaps, most infamously, WannaCry. In many attacks, millions of dollars were lost by end users and companies, who had to pay to have their files "unlocked.” WannaCry was considered a worldwide cyberattack, as it infected over 200K users in 150 different countries. Victims of WannaCry were confronted with this taunting message:

Ooops, your files have been encrypted! Many of your documents, photos, videos […] are no longer accessible. Maybe you are busy looking for a way to recover your files, but do not waste your time.

Can you recover files? Sure. We guarantee that you can recover all your files safely and easily, but you have not enough time. You only have 3 days to submit the payment. After that, the price will be doubled. Also, if you don’t pay in 7 days, you won’t be able to recover your files forever.

Home Title Lock - Who Are They? Should your Clients Buy It?

Have your heard advertising on local radio station for Home Title Lock? The ad warns that house stealing and deed fraud is the "latest scam."

According to the company’s website, Home Title Lock is a subscription-based monitoring and notification service. In the company’s own words: “For pennies a day, Home Title Lock posts a virtual perimeter around your home’s online title and mortgage. The instant we detect anyone tampering with your title or mortgage, we’re on it alerting you and mobilizing to help shut it down. In the unlikely event your title or mortgage is compromised, our U.S. based Resolution Experts will assist until the matter is resolved.” It is not, however, advertised as an insurance product. The point of the service is to detect the fraud and notify you so that you can stop it, presumably by involving law enforcement. 

How is this product different from an owner title insurance policy?

While title insurers do not "monitor" the title, ALTA Owner Policies contain Covered Risks insuring against loss or damage resulting from fraud. Also, Expanded Owner Policies provide coverage against the risk of loss resulting from forgery or impersonation both before AND AFTER the Policy Date! Who knew that buying an OP would provide defense costs to fight off post-closing fraud.
