HHS Announces $2 Billion Quality Incentive Program
for Nursing Homes
 
Yesterday, September 3, the US Department of Health and Human Services (HHS) announced its $2 billion quality incentive program for nursing homes as part of the $5 billion tranche announced on August 7 of CARES Act funding for COVID relief. Each month, starting in September through December, $500 million will be distributed to nursing homes according to performance on COVID-19 case rates and risk adjusted COVID-19 death rates. Performance will be determined from the National Healthcare Safety Network (NHSN) data submissions and audits relative to county per-capita rates. No further details have been released at this time.

AHCA/NCAL Webinar on CMS COVID-19 Performance Payment Program

AHCA/NCAL is scheduling a webinar on Tuesday, September 8 from 1:00-2:30 pm Eastern. Mark Parkinson and CMO David Gifford will review the new rule, answer questions, and discuss resources available to help members with this program.

Reminder: Assisted Living Federal Funding
and Testing Coming
 
On September 2, HHS announced that private-pay assisted living/memory care providers will be eligible to apply for CARES Act Provider Relief Funds under the current Phase 2 General Distribution round of funding. HHS also announced it will ship rapid antigen tests to assisted living communities.
 
Like other providers applying for Phase 2 funding, eligible assisted living communities will receive 2 percent of their annual revenue from patient care and will have until September 13, 2020 to begin their application. Please visit the Provider Relief Fund webpage for more information.
 
VHCA-VCAL will carefully review this announcement and follow up with specific details to help you with your potential application.
 
Keep in mind that the $20 million available for COVID-19 expenses from the CARES Act money received by the state is intended to be the funding “of last resort.” It is likely that DMAS will modify the invoice for ALFs to include any funds received by the ALFs from the CARES Act per this announcement. ALFs should be able to use the direct CARES Act for costs incurred from the onset of the pandemic (per HHS terms and conditions) and not limited to after June 30, but DMAS will need to track those funds and expenditures to determine if any of the CARES Act money remains available after June 30. On the NF side, if any direct CARES Act relief remains available, access to the state’s allocation is not allowed until it is fully exhausted; we would anticipate that DMAS would also apply this approach on the ALF side for access to the $20 million. When we hear from DMAS regarding those plans, we will communicate them to the membership.
 
Rapid, Antigen Tests to be Delivered to Assisted Living Communities 
 
It was also announced by an HHS official that the federal government plans to ship rapid COVID-19 tests to assisted living communities across the country. The tests will come from a supply of 150 million ordered from test maker Abbott Laboratories, and are expected to be delivered in the coming two to three weeks.
 
As we learn more about these tests and the shipments, we will keep you informed.
 
These announcements are much-welcome news for assisted living providers who have been fighting over the last six months to keep your residents safe and stay afloat during this unprecedented crisis.
Reminder: CMS Posts New County COVID-19 Test Positivity Rates Used to Determine Your Routine Testing of Staff
 
Last week, CMS issued an interim final rule that requires nursing homes to routinely test staff for COVID-19 effective September 2, 2020. CMS issued QSO memo 20-38 describing how to comply with the new regulation and that routine staff testing is based on the county COVID-19 test positivity rate. 

CMS posted today a new excel file dated 9-2-20 that flags each county as green, yellow and red that should be used to dictate your routine testing frequency of staff that is based on data from August 20-August 26. Rates of county positivity are posted here. Please use this new file in place of the prior file in setting your routine testing frequency. 

If your county is:
 green counties must test staff 1 x per month
📒 yellow counties must test 1 x per week 
🚩red counties must test 2 x per week

CMS has indicated they will post an updated file on the 1st and 3rd Mondays of each month. 

Clarification to New CMS Testing Requirements for Residents

As a reminder, routine testing of asymptomatic residents is not recommended nor required per the new CMS testing requirements for nursing facilities. The following information has been summarized from QSO-20-38-NH: Interim Final Rule (IFC), CMS-3401-IFC, Additional Policy and Regulatory Revisions in Response to the COVID-19 Public Health Emergency related to Long-Term Care (LTC) Facility Testing Requirements and Revised COVID19 Focused Survey Tool.
* For outbreak testing, all staff and residents should be tested, and all staff and residents that test negative should be retested every 3 days to 7 days until testing identifies no new cases of COVID-19 infection among staff or residents for a period of at least 14 days since the most recent positive result.
