Unfortunately, the closing attorney on his mortgage failed to make him aware of the available homestead protections, and a lien was placed on his home for $23,000. There was no way he could have paid this off since social security is his sole income source. The opposing party tried to force our client to sell his home to pay off the debt, but luckily, Attorney Slattery agreed to take on this case.
Attorney Slattery noticed the issue regarding homestead protection not being applied and negotiated a settlement of the underlying judgment. At no expense to our client, the closing attorney would settle the debt using his malpractice insurance.
