Variance Request Forms
The Ohio Department of Commerce requires all variance requests to be submitted to with the subject line “Variance Request.” Please CC your assigned compliance agent.

Licensees are required to submit the Variance Request Form and all other applicable information to be considered for a variance. For a variance to be granted, the request must meet all three requirements of O.A.C. 3796:5-6-04 .
Pharmacy Communication
Product Returns
The State of Ohio Board of Pharmacy communicated the below message to dispensaries this week. We wanted to share this with you because you may receive questions from dispensaries regarding refunds. As detailed below, providing a refund is at the discretion of the licensee. If you have any questions regarding this, please contact :

"In light of the CDC’s recommendation that individuals “consider refraining from using e-cigarette, or vaping products, particularly those containing THC,” we understand that patients and caregivers may ask about returning previously purchased vaporizing cartridges. It is the Board’s policy that medical marijuana products sold as an oil or solid for vaporization may be returned by patients for a cash refund. While refunds are permitted, it is at the discretion of the licensee to refund the patient. Products may not be returned in exchange for another product."
e-Licensing Updates
Advertising, Packaging and Strain Names
The Ohio Department of Commerce requires licensees to upload advertising, packaging, and strain name submissions into e-Licensing for approval.

Applications for advertising and packaging will no longer be reviewed if submitted to the inbox after November 1.

Strain name applications must be submitted via e-Licensing effective immediately. 
MMCP Program Updates
The Ohio Department of Commerce has issued the following provisional licenses as a result of the administrative appeals process:

  • Green Thumb Industries (GTI), Level I Cultivator
  • Green Investment Partners, Level I Cultivator

The following Certificates of Operation have been issued. To view the specific licensees with certificates of operation, please click here.

  • Level I Cultivators: 9 of 19 provisional licensees
  • Level II Cultivators: 9 of 13 provisional licensees
  • Processors: 10 of 41 provisional licensees
  • Testing Labs: 3 of 5 provisional licensees

The following are program sales totals from Jan. 16, 2019 to Sept. 30, 2019:

  • Pounds of Plant Material – 3,568
  • Units of Manufactured Product – 102,904
  • Total Product Sales – $29,794,789
  • Total Receipts – 223,727
