Palmetto Bay Officials to Meet with the Board of County Commission & the Transportation Planning Organization
Following a series of meetings with officials from Miami-Dade County and officials from the Transportation Planning Organization (TPO), the Village of Palmetto Bay will be meeting with both entities on January 20, 2022 as part of the final phases of its conflict assessment resolution process. The process is mandated by Florida law when two governmental entities reach a disagreement before any litigation may be sought. The Village of Palmetto Bay initiated the conflict assessment proceedings with both entities following the approval of the SW 87th Avenue Bridge project which will extend SW 87th Avenue from SW 164th Street to SW 163rd Terrace, over the C-100 canal.

In its case with the Board of County Commission, the Village has argued that approval was granted under an emergency policy related to the COVID-19 pandemic and the bridge project does not constitute such an emergency. Palmetto Bay also argued that funding for the project was allocated via a resolution when an ordinance is required instead. Consequently, the Village asked the TPO, acting in its own capacity as a separate entity from the county, to rescind its approval resolution citing the issues with the county's approval process. Despite its request, Miami-Dade County held a public meeting on December 15, 2021 to discuss the project scope and get public feedback. Two weeks earlier, during a Special Council meeting on November 29, 2021, the Village Council approved a resolution expressing objection to County Mayor Daniella Levine Cava concerning the County's decision to construct the SW 87th Avenue bridge.

The upcoming meetings are the next step in the conflict assessment resolution process.

NOTICE IS GIVEN that pursuant to section 164.1055 of the Florida Statutes, a Joint Public Meeting between the Village of Palmetto Bay and Miami-Dade County will be held on Thursday, January 20, 2022 at 12:45 p.m. in the Commission Chambers located on the second floor of the Stephen P. Clark Center, 111 N.W. 1st Street, Miami, FL 33128. The Joint Public Meeting will be attended by the Honorable Village of Palmetto Bay Mayor and Council and Honorable Members of the Miami-Dade County Board of County Commissioners. The subject matter of the Joint Public Meeting is to conduct conflict resolution proceedings pursuant to Chapter 164, Florida Statutes, between the Board of County Commissioners and the Village Council, regarding the Board of County Commissioners’ Resolution No. R-88-21 pertaining to the construction of a bridge that would extend SW 87th Avenue from SW 164th Street to SW 163rd Terrace over the Cutler Drain Canal C-100.

Interested parties may:

(1) view a live broadcast of the Joint Public Meeting in the lobby of the Stephen P. Clark Government Center, located on the first floor;
(2) speak, where permissible, in the Miami-Dade Commission Chambers located on the second floor of the Stephen P. Clark Government Center; members of the public will be required to register to speak on the first floor and will be escorted to the Commission Chambers at the appropriate time;

Pursuant to section 164.1055 of the Florida Statutes, a Joint Public Meeting between the Village of Palmetto Bay and the Transportation Planning Organization (TPO) will be held on Thursday, January 20, 2022, at the later of 3:00 p.m. or immediately following the adjournment of the regularly calendared TPO Governing Board meeting noticed for 2:00 p.m. in the TPO Governing Board Chambers located at the Museum Tower, 150 West Flagler Street, Suite 1924, Miami, Florida 33130. The Joint Public Meeting will be attended by the Honorable Village of Palmetto Bay Mayor and Council (the “Village Council”) and Honorable Members of the TPO Governing Board. The subject matter of the Joint Public Meeting is to conduct conflict resolution proceedings pursuant to Chapter 164, Florida Statutes, between the TPO Governing Board and the Village Council, regarding the TPO Resolution #08-2021 pertaining to the construction of a bridge that would extend SW 87th Avenue from SW 164th Street to SW 163rd Terrace over the Cutler Drain Canal C-100.

This meeting is open to the public to attend. Interested parties may:

(1) attend the meeting and speak where permissible in the TPO Governing Board Chambers located on the nineteenth floor of the Museum Tower;
(2) view a live broadcast on Miami-Dade Television;
